CNIL ACTION - LAW ANDERAL, LLC, d/b/a WILCOX FORGING COMPANY, and ROGER CONRAD, Defendants JURY TRIAL OF TWELVE DEMANDED COMPLAINT 1. Plaintiffs, Eric T. Querry and Katherine Querry, husband and wife, are adult individuals residing at 401 East Main Street, Mechanicsburg, Pennsylvania 17055 ("residence"). 2. Defendant, Anderal, LLC, d/b/a Wilcox Forging Company ("Anderal"), is a Pennsylvania business corporation with a registered address at 320 East Allen Street, Mechanicsburg, Pennsylvania 17055, and a place of business at 1609 Cascade Street, Erie, Pennsylvania 16502. 3. Defendant, Roger Conrad ("Conrad"), is an adult individual residing at 1811 Centerville Road, Newville, Cumberland County, Pennsylvania 17241. 4. At all relevant times hereto, Defendant Conrad was an employee of Defendant Anderal. 5. On or about October 22,2003, Defendant Anderal had hired Defendant Conrad to demolish a building or buildings located at 320 East Allen Street, Mechanicsburg, Pennsylvania 17055. 6. Defendant Conrad was hired by Defendant Anderal to perform inherently dangerous activities. 7. On or about October 22,2003, Defendant Anderal's building caught fire. 8. The fire was a result of Defendant Conrad's negligence, recklessness, and carelessness. 9. On or about October 22, 2003, Plaintiffs' residence was overcome by smoke and other damaging substances from the fire. 10. On or about October 22,2003, Plaintiffs' residence suffered damages in the amount of$5,669.65. A true and correct copy of the appraisal is attached hereto as Exhibit "A." COUNT I 11. Paragraphs 1-10 are incorporated herein by reference as if fully set forth below. 12. The aforementioned damages were caused as the result of the negligence, recklessness, and carelessness of Defendant Conrad in that he, among other things: a. Failed to perform his duties in a workmen like fashion; b. Failed to use materials and tools that would not cause a fire; c. Failed to properly operate the cutting torch; and d. Failed to safely demolish the structure. 13. Defendant Conrad was the direct and proximate cause of the damages to Plaintiffs' residence. WHEREFORE, Plaintiffs demand compensation from Defendant Conrad in the amount of $5,669.65, plus attorney's fees, costs, interest, and any other reliefthat the court deems appropriate. COUNT II 14. Paragraphs 1-13 are incorporated herein by reference as if fully set forth below. 15. The aforementioned damages were caused as the result of the negligence, recklessness, and carelessness of Defendant Anderal in that it, among other things: a. Selected Defendant Conrad to perform the demolition knowing that he was not insured; b. Selected Defendant Conrad to perform the demolition knowing that he was not experienced enough to handle the job; c. Hired Defendant Conrad to perform the demolition knowing that a dangerous condition existed; d. Employed Defendant Conrad to conduct inherently dangerous activities that he was not trained to handle; and e. Failed to properly supervise Defendant Conrad in the demolition process. 16. Defendant Anderal was the direct and proximate cause of the damages to Plaintiffs' residence. WHEREFORE, Plaintiffs demand compensation from Defendant Anderal in the amount of $5,669.65, plus attorney's fees, costs, interest, and any other relief that the court deems appropriate. COUNT III 17. Paragraphs 1-16 are incorporated herein by reference as if fully set forth below. 18. Smoke, among other things, from Defendant Andera1' s property physically invaded Plaintiffs' residence. 19. Defendant Andera1' s intent to demolish the building caused the physical invasion onto Plaintiffs' property and throughout their residence. 20. Defendant Anderal's demolition caused the fire to the structure. 21. The fire resulted in the smoke damage, among other things, to Plaintiffs' property. WHEREFORE, Plaintiffs demand compensation from Defendant Anderal in the amount of $5,669.65, plus attorney's fees, costs, interest, and any other reliefthat the court deems appropriate.
