D'Emilio, Esquire, bring this action upon a cause whereof the following is a statement: 1. The Plaintiff, State Farm Fire and Casualty Company, ( "Plaintiff') is a Corporation authorized to do business in the Commonwealth of Pennsylvania, with a mailing address of P.O. Box 2013, Mechanicsburg, PA 17055. 2. Plaintiff brings this action -as subrogee of Richard Uber and Luann Kauffman (herein the "Insured ") under a policy of insurance issued by Plaintiff and at all times hereinafter mentioned, is the real and registered owner of premises 700 Nailor Drive, Camp Hill, PA 17011. 3. Defendants Mamame Abdou -Maman aka Mamane Sani Maman and Bassira Zada are individuals currently residing at the above captioned address and at all times hereinafter mentioned was a tenant or occupant of Plaintiff's Insured. 4. On or about December 1, 2010 , the Defendant and executed a Agreement of Lease, pursuant to which, Defendant rented 700 Nailor Drive, Apt. 108, Camp Hill, PA 17011 from Plaintiff's Insured. A true and correct copy of the Agreement of Lease is attached hereto, made part hereof and marked Exhibit "A." 5. On or about August 23, 2012 the Defendant Mamame Abdou -Maman aka Mamane Sani Maman and /or Bassira Zada left the burner of the stove on which started a fire in the kitchen at 700 Nailor Drive, Apt. 108, Camp Hill, PA 17011 causing damage to the Insured's property. 6. Plaintiff avers that the personal property of the Insured Richard Uber was damaged as a result of the occurrence hereinbefore mentioned, the cost to repair the dwelling thereto being is One Hundred Three Thousand Nine Hundred Seventy One and 72/100 ($103,971.72) plus the Insured's deductible of Five Thousand and 00 /100 ($5,000.00) Dollars plus loss of using being of One Thousand One Hundred Fifty and 00/100 ($1,150.00) Dollars for a total of One Hundred Ten Thousand One Hundred Twenty One 72/100 ($110,121.72) Dollars. 7. Plaintiff avers that the personal property of the Insured Luann Kauffman was damaged as a result of the occurrence hereinbefore mentioned, the cost to replacement of contents thereto being is Eight Thousand Six Hundred Seventeen and 52/100 ($8,617.52) plus the Insured's deductible of Two Hundred Fifty and 00/100 ($250.00) Dollars plus additional living expense being Nine Hundred Seventy Two and 00/100 ($972.00) Dollars for a total of Nine Thousand Eight Hundred Thirty Nine 52/100 ($9,839.52) Dollars. Count Breach of Contract 8. Plaintiff, incorporates by reference all of the allegations contained in paragraphs T through 7 inclusive of this Complaint as fully as though same were herein and set forth at length. 9. Defendants, violated the Lease Agreement in that they caused and /or allowed a fire to occur at the rental property and failed to repair same in violation of the written agreement. 10. Defendants, violated the Lease Agreement because they failed to obtain an insurance policy. 11. Although frequent demands have been made, Defendants have failed, refused and neglected and continues to fail, refuse and neglect to make payment of the balance due. Count III Negligence 12. Plaintiff incorporates by reference all of the allegations contained in paragraphs 1 through 11 inclusive of this Complaint as fully as though same were herein and set forth at length. 13. The said occurrence was due to the negligence of the Defendants in that they: a. allowed a fire to start in the property without due regard for the rights, safety and position of the Insured property; b. negligently failed to ensure the safety of the Insured's property; C. allowed a fire to start in the premises; d. allowed a fire at the premises to cause damage to the Insured's property; e. failed to take proper precautions against fire while cooking; f. did fail to use due care under the circumstances; and g. did violate the various statutes and laws of the County of Cumberland County, and Commonwealth of Pennsylvania. WHEREFORE, Plaintiff demands judgment against the Defendants on each Count in an amount in excess of Fifty Thousand and 00/100 ($50,000.00) dollars together with costs of suit. Date: Paul .
