STIPULATION AGAINST LIENS
THIS AGREEMENT made this 20 day of A 2013, by
and between
FARINELLI CONSTRUCTION, INC., hereinafter referred to as
Contractor,
AND
Matthew W. Lipsett and Erin Mandalino- Lipsett, husband and wife,
hereinafter referred to as Owner, whereby the contractor undertook
and agreed to erected and construct a single family dwelling
situate in Upper Allen Township, Cumberland County, Commonwealth
of Pennsylvania, and more fully described in Exhibit " A " which is
attached hereto and made a part hereof known as Lot 82, Meadowview
Estates, Mechanicsburg, PA 17055.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL THAT parcel of land located in Upper Allen Township, Cumberland County,
Pennsylvania, known as Lot 82 of a subdivision of Meadowview Estates, Section H,
Phase VI -A and as recorded September 18, 2008 in the Cumberland County
Courthouse as Instrument No. 200831753.
BEGINNING at a point, said point being on the southwesterly right of way line of
Morning Star Court and is located North 47 degrees, 27 minutes, 21 seconds West,
625.00 feet from the centerline intersection of South View Drive and Morning Star
Court and South 42 degrees, 32 minutes, 39 seconds West, 25 feet to the said right of
way of Morning Star Court, also being the corner of Lot 81 of said subdivision.
Thence continuing South 42 degrees, 32 minutes 39 seconds West, a distance of
180.00 feet to a point; thence North 47 degrees, 27 minutes 21 seconds West, a
distance of 140.00 feet to a point; thence North 42 degrees 32 minutes, 39 seconds
East, a distance of 181.03 feet to a point; thence South 47 degrees, 27 minutes, 21
seconds East, a distance of 26.12 feet to a point on the cul -de -sac right of way of
Morning Star Court; thence continuing along said right of way an arc to the left
having a radius of 50.00 feet and an arc length of 95.59 feet with a chord bearing of
South 40 degrees 52 minutes 29 seconds East, a chord length of 81.68 feet to a point;
thence continuing along said right of way an arc to the right having a radius of 25.00
feet and an arc length of 21.03 feet, a chord bearing of South 71 degrees 33 minutes
09 seconds East, with a chord length of 20.412 feet on said right of way to a point;
thence South 47 degrees 27 minutes 21 seconds East, a distance of 14.10 feet, being
the point and Place of BEGINNING.
SUBJECT to a 30 feet wide utility easement along the entire length of the rear of the
lot along lands now or formerly of Upper Allen Township (Friendship Park) and a
20 feet utility easement along the northwesterly property line adjacent to Lot 83.
UNDER AND SUBJECT, NEVERTHELESS, to the Declaration of Restrictive
Covenants dated October 28, 2009, and recorded October 30, 2009 in the
Cumberland County Recorder of Deeds Office in Instrument #200936967.
FURTHER, UNDER AND SUBJECT, to an Easement Agreement for Fence and
Buffer plantings within existing Municipal Storm Water and Utility Easement dated
November 17, 2010 and recorded on November 18, 2010 in the Cumberland County
Recorder of Deeds Office in Instrument #201033724.
BEING the same premises which Cindy L. Arnold - Steele, et al by deed dated
12/21/12 and recorded 12/21/12 in Instrument No. 201239964 granted and conveyed
unto Farinelli Construction, Inc.
