Bangs, Esquire, and files this Complaint based upon the following: 1. Plaintiff, Patricia Ann Snoke ("Snoke") is an adult individual who resides at 34996. South Drive, Lewes, Delaware, 19958. Snoke is the owner of a residential property known as 2 . Commercial Drive, Camp Hill, Pennsylvania, 17011 ("Premises"). 2. Defendant, Melody Siegrist Cenkner ("Cenkner") is an adult individual who currently resides as the Premises. 3. On or about 14 August 2012, Snoke and Cenkner entered into a Standard Lease Agreement for the lease of the Premises ("Lease"). Attached hereto and marked as Exhibit A is a true and correct copy of the Lease. 4. The Lease has specific provisions regarding the number of individuals who are permitted in the Premises which is no more than three. 5. The Lease has specific provisions regarding pets in that there are no more than two dogs permitted in the Premises. 1 6. When Snoke leased the Premises to Cenkner, the provisions regarding the number of occupants and the pets were pointed out to Cenkner and were important provisions for Snoke because wanted to maintain the condition of the Premises.. 7. Snoke specifically did not want any cats in the Premises in that she is allergic to cats and was concerned about the cats ruining the interior of the Premises. 8. Cenkner specifically indicated and showed Snoke that she only had two small dogs and based upon that representation, Snoke leased the Premises to her with the inclusion of the two dogs. 9. Snoke became aware that Cenkner had violated the Lease in or around November, 2012 in that she had cats on the Premises. 10. Snoke, through her attorney, advised Cenkner to have the cats removed, otherwise she would be in default. 11. Snoke lives out of town and could not regularly inspect the Premises and assumed that Cenkner had complied with removal of the cats. 12. In May, 2013, Snoke was informed of an incident that allegedly occurred at the Premises whereby someone broke the front window. 13. Snoke then caused an inspection of the Premises to occur in May, 2013. 14. Upon arrival at the Premises. Snoke became aware that the cats had not been removed and in fact there were five cats on the Premises, either living inside or outside the Premises that belonged to Cenkner. 2 15. Snoke also became aware that there were five individuals living in the Premises in violation of the Lease in that Cenkner had moved her parents into the Premises without notification or approval. 16. Upon the inspection in May; Snoke also saw that the Premises was in a deplorable condition; the Premises had an odor of cats; was stacked floor to ceiling with furniture and other debris; and was otherwise in an unsatisfactory condition. 17. Cenkner also owes Snoke for late fees as a result of her failure to pay monthly rent checks on time. 18. On or about June 11, 2013, Snoke caused a Notice of Default to be sent out by her attorney to Cenkner itemizing the defaults and giving her thirty (30) days in which to cure those defaults. Attached hereto and marked as Exhibit B is a true and correct copy of the Notice. 19. The Notice provided for thirty (30) days in which to cure the defaults although the Lease does not require a thirty (30) day notice of default. 20. Cenkner failed to cure the default within thirty (30) days in that there are cats still on the Premises; there are still more than three people living in the Premises; and the late charges have not been paid in full. 21. Additionally, Snoke caused a Notice dated July 23, 2013 wherein Cenkner was notified that the Lease would not be extended pursuant to the language of the Lease identified as "Term." Attached hereto and marked as Exhibit C is a true and correct copy of the Notice. COUNT POSSESSION 22. Paragraphs 1 through 21 are incorporated herein by reference. 3 23. Cenkner defaulted on the terms of the Lease by her failure to comply with specific provisions, namely the number of people in the Premises; having cats in violation of the terms of the Lease; and not paying all late fees incurred. 24. Cenkner did not cure the default after notice. 25. Snoke properly terminated the Lease and should be granted possession of the Premises. 26. Separate and apart from the default, Snoke terminated the Lease under its Term. 27. Cenkner is not permitted to remain in the Premises post-August 31, 2013; otherwise she is deemed a holdover under the terms of the Lease. WHEREFORE, Snoke requests this Honorable Court to grant her possession of the Premises. COUNT II DAMAGES 28. Paragraphs 1 through 27 are incorporated herein by reference. 29. Cenkner has failed to pay all late fees due and owing which were originally set at $500.00 by agreement. The remaining balance is approximately $300.00. 30. Cenkner is a holdover under the terms of the Lease and as such, is required to pay two times the monthly rent applicable for each month she continues as a holdover. The amount due for that monthly rent as a holdover is $2,200.00. 31. Snoke has been damaged as a result of the breach of the terms of the Lease in that Cenkner owes late fees which continue to accrue and for all unpaid rent that is accruing as a result of Cenkner being a holdover. 4 WHEREFORE, Snoke demands damages against.Cenkner in the amount of$2;500.00 plus an additional $2,200.00 per month for each month that she remains in possession of the Premises as a holdover. No. 13-5002 Melody Siegrist Cenkner, Defendant DEFENDANT'S PRELIMINARY OBJECTIONS TO PLAINTIFF'S COMPLAINT Defendant, Melody Siegrist Cenkner, by and through her attorneys, Wayne S. Martin, Esquire and Reager & Adler, P.C., hereby files these Preliminary Objections to Plaintiff's Complaint. In support thereof, Defendant avers the following: 1. Plaintiff, Patricia Ann Snoke ("Snoke"), filed the instant action against Defendant, Melody Siegrist Cenkner("Cenkner") seeking possession of the property located at 2 Commercial Drive, Camp Hill, Pennsylvania, 17011 ("Property"). Snoke is also seeking damages related to an alleged agreement between the parties and for alleged holdover damages. A copy of Plaintiffs Complaint is attached hereto as Exhibit "A." 2. On August 14, 2012, the parties entered into a contract governing their rights and responsibilities with respect to Cenkner's occupancy and purchase of the Property, which is referred to in the Complaint as the "Lease." A copy of the Lease is attached to the Complaint as Exhibit A. 1 Preliminary Objection Pursuant to Pa.R.C.P. 1028(a)(6) (Agreement for Alternative Dispute Resolution) 3. The Standard Agreement for the Sale of Real Estate, which is incorporated into the Lease, has a mediation clause at paragraph 23 under whose terms the parties agreed to submit any disputes arising from the agreement, including specifically disputes and claims over deposit monies, to mediation. 4. The claims made by Snoke in this action are subject to the mediation clause of the agreement between the parties. Specifically, Snoke has brought this action to have this Court find Cenkner in material breach of the terms and conditions of the Lease, which Snoke alleges terminates Cenkner's right to purchase the Property and entitles Snoke to retain the $10,000 security deposit made by Cenkner. These averments are specifically set forth in the letters drafted by Snoke's attorney which are incorporated into the Complaint as Exhibit B and Exhibit C. 5. In light of the mediation provision of the contract between the parties, particularly where the parties specifically agreed that all disputes and claims over deposit monies be submitted to mediation, Snoke's Complaint should be dismissed. 6. Snoke has not waived her right to have this dispute submitted to mediation as a prerequisite to litigation. WHEREFORE, Defendant respectfully requests that its Preliminary Objections to Plaintiffs Complaint be sustained and that the Complaint be dismissed. Preliminary Objection Pa. R.C.P. 1028(a)(4) (In the Nature of a Demurrer) 7. Pa. R.C.P. 1028(a)(4) authorizes the assertion of a preliminary objection for the legal insufficiency of a pleading. 8. At paragraph 29 of the Complaint, Snoke references an agreement for late fees which allegedly supersedes the Lease. This allegation forms the basis for Count II of the Complaint. 9. Pa. R.C.P. 1019(h) requires that, when any claim or defense is based upon an agreement, the pleading shall state specifically whether the agreement is oral or written. If the agreement is in writing, it must be attached to the pleading. 10. Pa. R.C.P. 1019(i) requires that when any claim or defense is based upon a writing, the pleader shall attach a copy of the writing or the material part thereof, but if the writing or copy is not accessible to the pleader, it is sufficient to so state together with the reason, and to set forth the substance in writing. 11. Because Snoke has failed to allege whether the agreement between the parties is oral or written and has failed to attach a copy of the alleged agreement she claims has been breached, Count II of Snoke's Complaint must be stricken and/or dismissed. Bangs, Esquire, and files this Complaint based upon the following: 1. Plaintiff, Patricia Ann Snoke ("Snoke") is an adult individual who resides at 34996 South Drive, Lewes, Delaware, 19958. Snoke is the owner of a residential property known as 2 Commercial Drive, Camp Hill, Pennsylvania, 17011 ("Premises"). 2. Defendant, Melody Siegrist Cenkner("Cenkner")is an adult individual who currently resides as the Premises. 3. On or about 14 August 2012, Snoke and Cenkner entered into a Standard Lease Agreement for the lease of the Premises ("Lease"). Attached hereto and marked as Exhibit A is a true and correct copy of the Lease. 4. The Lease has specific provisions regarding the number of individuals who are permitted in the Premises which is no more than three. 5. The Lease has specific provisions regarding pets in that there are no more than two dogs permitted in the Premises. 1 N 1 6. When Snoke leased the Premises to Cenkner,the provisions regarding the number of occupants and the pets were pointed out to Cenkner and were important provisions for Snoke because wanted to maintain the condition of the Premises. 7. Snoke specifically did not want any cats in the Premises in that she is allergic to cats and was concerned about the cats ruining the interior of the Premises. 8. Cenkner specifically indicated and showed Snoke that she only had two small dogs and based upon that representation, Snoke leased the Premises to her with the inclusion of the two dogs. 9. Snoke became aware that Cenkner had violated the Lease in or around November, 2012 in that she had cats on the Premises. 10. Snoke,through her attorney, advised Cenkner to have the cats removed, otherwise she would be in default. 11. Snoke lives out of town and could not regularly inspect the Premises and assumed that Cenkner had complied with removal of the cats. 12. In May, 2013, Snoke was informed of an incident that allegedly occurred at the Premises whereby someone broke the front window. 13. Snoke then caused an inspection of the Premises to occur in May, 2013. 14. Upon arrival at the Premises, Snoke became aware that the cats had not been removed and in fact there were five cats on the Premises, either living inside or outside the Premises that belonged to Cenkner. 2 �a 15. Snoke also became aware that there were five individuals living in the Premises in violation of the Lease in that Cenkner had moved her parents into the Premises without notification or approval. 16. Upon the inspection in May, Snoke also saw that the Premises was in a deplorable condition; the Premises had an odor of cats; was stacked floor to ceiling with furniture and other debris; and was otherwise in an unsatisfactory condition. 17. Cenkner also owes Snoke for late fees as a result of her failure to pay monthly rent checks on time. 18. On or about June 11, 2013, Snoke caused a Notice of Default to be sent out by her attorney to Cenkner itemizing the defaults and giving her thirty (30) days in which to cure those defaults. Attached hereto and marked as Exhibit B is a true and correct copy of the Notice. 19. The Notice provided for thirty(30) days in which to cure the defaults although the Lease does not require a thirty(30) day notice of default. 20. Cenkner failed to cure the default within thirty (30) days in that there are cats still on the Premises; there are still more than three people living in the Premises; and the late charges have not been paid in full. 21. Additionally, Snoke caused a Notice dated July 23, 2013 wherein Cenkner was notified that the Lease would not be extended pursuant to the language of the Lease identified as "Term." Attached hereto and marked as Exhibit C is a true and correct copy of the Notice. COUNT POSSESSION 22. Paragraphs 1 through 21 are incorporated herein by reference. 3 t 23. Cenkner defaulted on the terms of the Lease by her failure to comply with specific provisions,namely the number of people in the Premises;having cats in violation of the terms of the Lease; and not paying all late fees incurred. 24. Cenkner did not cure the default after notice. 25. Snoke properly terminated the Lease and should be granted possession of the Premises. 26. Separate and apart from the default, Snoke terminated the Lease under its Term. 27. Cenkner is not permitted to remain in the Premises post-August 31, 2013; otherwise she is deemed a holdover under the terms of the Lease. WHEREFORE, Snoke requests this Honorable Court to grant her possession of the Premises. COUNT II DAMAGES 28. Paragraphs 1 through 27 are incorporated herein by reference. 29. Cenkner has failed to pay all late fees due and owing which were originally set at $500.00 by agreement. The remaining balance is approximately$300.00. 30. Cenkner is a holdover under the terms of the Lease and as such, is required to pay two times the monthly rent applicable for each month she continues as a holdover. The amount due for that monthly rent as a holdover is $2,200.00. 31. Snoke has been damaged as a result of the breach of the terms of the Lease in that Cenkner owes late fees which continue to accrue and for all unpaid rent that is accruing as a result of Cenkner being a holdover. 4 f WHEREFORE, Snoke demands damages against Cenkner in the amount of$2,500.00 plus an additional $2,200.00 per month for each month that she remains in possession of the Premises as a holdover. Pa.R.C.P. 206.1 defines a "petition" as (1) an application to open a default judgment or a judgment of non pros, and (2) any other application which is designated by local rule numbered Local Rule 206.1(a), to be governed by Rule 206.1 et seq. Cumberland County Local Rule 206.1(a) adds that petition practice shall also be applicable to petitions to transfer venue on grounds of forum non conveniens and petitions which seek the issuance of a rule to serve the interest of justice. The petition filed by Plaintiff is not an application to open a default judgment nor is it a judgment of non pros. Similarly, it is not a petition to transfer venue and it did not seek the issuance of a rule. The petition filed by Plaintiff was improper and should be denied. Answer to Petition 1. Admitted in part, denied in part. It is admitted that Plaintiff is the title owner of 2 Commercial Drive, Camp Hill, Pennsylvania, 17011. However, per the agreement between the Plaintiff and Defendant attached to the Complaint as Exhibit A, Defendant has been paying monies toward the purchase of the property and has a legal interest in the property. 2. Admitted in part, denied in part. It is admitted that Defendant is a tenant. However,per the agreement between the Plaintiff and Defendant attached to the Complaint as Exhibit A, Defendant has been paying monies toward the purchase of the property and has a legal interest in the property. 3. It is admitted that Plaintiff filed an improper landlord/tenant action with the Magisterial District Court which lacked jurisdiction to hear the matter and was granted a judgment for possession and a judgment for rent in arrears. It is denied that there was any rent in arrears and Plaintiff has essentially admitted that there is no rent in arrears by filing a Complaint with this honorable Court that does not allege rent arrears. Instead, the Complaint alleges at paragraph 29 that the $300 are for late fees pursuant to an agreement which allegedly supersedes the agreement between the parties that is attached to the Complaint. 4. Admitted. 5. Admitted in part, denied in part. It is admitted that Plaintiff has filed a Complaint. It is denied that Plaintiff is awaiting Defendant's Answer because on September 27, 2013 Defendant filed Preliminary Objections to Plaintiff's Complaint endorsed with a notice to plead because the parties agreed in writing to mediate these disputes. Plaintiff has not yet filed a response to Defendant's Preliminary Objections. 6. Denied. Defendant has deposited the amount of$300.00 with the Prothonotary's office on August 22, 2013 and Defendant deposited an additional $1,100.00 with the Prothonotary's office on September 18, 2013 to act as supersedeas per Pa.R.C.P.M.D.J. 1008. The deposit amounts are based upon the magisterial district judge's order of judgment not Defendant's belief. Defendant denies that there are any rent arrears and Defendant denies that the rent is $1,100.00 per month where the agreement between the parties attached to the Complaint states that"Tenant will be given credit against the purchase price a total of$375.00 each month for every monthly rental payment made to Landlord..." Although Plaintiff has not defaulted on the agreement between the parties, Plaintiff has declared Defendant in default which Plaintiff alleges terminates Defendant's right to purchase the Property and entitles Plaintiff to retain the $10,000 security deposit made by Defendant. These averments are specifically set forth in the letters drafted by Plaintiff's attorney which are incorporated into the Complaint as Exhibit B and Exhibit C. 7. Denied. It is denied that Plaintiff has cited a rule that would entitle her to relief as there is no Pa.R.C.P.M.D.J. 108(b).
