Barry, by and through her counsel, Mateya Law Firm and Mark A. Mateya, Esquire, requests that this Court grant the special relief, as spelled out more fully below. Mateya Law Firm, P.C., entered its appearance and Att��'ney Rogetrrlrwi�v��s rv withdrawn by Order of this Court on August 16th. See Exhibit A. 4. On August 29, 2013, Attorney Roger Irwin informed Mateya Law Firm that he was holding$15,235.65, as a fiduciary for the estate of Nancy M. Barry, in his law firm's IOLTA account. See Exhibit B. 5. There is a dispute between the executrix, Karen Greguras, and her former counsel, Roger Irwin, over the amount which is to be paid to Attorney Irwin for the work performed. Attorney Irwin has invoiced the estate $3,081.25. See Exhibit C. 6. Attorney Roger Irwin presented no fee agreement to Karen Greguras at any time during the three months which he assisted in the administration of the estate of Nancy M. Barry. 7. Petitioner,by and through her counsel Mateya Law Firm, has made good faith offers in an attempt to settle the dispute. The offers have not been accepted as of the time of this writing. 8. Roger Irwin has asserted his right to an attorney's lien and continues to hold the entire $15,235.65 in funds which he has identified as the part of his IOLTA fund that belongs to the estate of Nancy M. Barry. 9. The total amount which Attorney Irwin continues to hold ($15,235.65) exceeds the attorney's lien($3,081.25) by$12,154.40. 10. Petitioner avers that Attorney Irwin has no legal right or claim to hold an amount in excess of the amount he claims is due him, which claimed amount the Executrix disputes. 11. Petitioner has asked Respondent if he concurs with the filing of this petition for special relief. Respondent does not concur with the filing of this petition. 12. Judge Thomas A. Placey has ruled in matters concerning this estate prior to this date. WHEREFORE, Petitioner requests this Court order Attorney Irwin to turn over to the executrix' counsel, Mateya Law Firm$12,154.40, and any other relief this Court deems appropriate.
