STIPULATION AGAINST LIENS
WHEREAS, KENNETH L. MSHAR is about to execute contemporaneously herewith, a contract
with YDW CUSTOM HOMES for the erection of a single-family dwelling upon ALL THAT CERTAIN
TRACT of land, situate in the in the Township of Monroe, County of Cumberland, and Commonwealth of
Pennsylvania, being more particularly bounded and described as follows, to wit:
BEGINNING at an existing stone pile at comer of lands now or formerly of Shillito
Enterprises, Inc.; thence from said beginning point along property now or formerly
of David Niesley, South 37 degrees 00 minutes 00 seconds West, three hundred sixty-
three and seventy-six hundreths (363.76) feet to an existing stone pile; thence by
property now or formerly of Richard Clark the; following two (2) courses and
distances: (1) North 28 degrees 40 minutes 08 seconds West, five hundred sixty-
seven and seventy-eight hundredths (567.78) feet to an existing stone pile around a
four-inch oak tree; (2) North 32 degrees 58 minutes 48 seconds East, three hundred
nine and forty-four hundredths (309.44) feet to an existing stone pile; thence along
lands now or formerly of Shillito Enterprises, Inc., South 33 degrees 24 minutes 06
seconds East, seven hundred sixteen and sixty-four hundredths (716.64) feet to the
point and place of BEGINNING.
CONTAINING 5.06 acres, according to a survey prepared by Stephen G. Fisher,
Registered Surveyor, dated April 22, 1980, arid being known and municipally
numbered as 1059D York Road, Dillsburg, PA 17019
BEING THE SAME PREMISES which Michael J. Home, single man, by deed
dated March 25, 1991, and recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Deed Book 35-A, at page 162, granted and
conveyed unto Kenneth L. Mshar.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the parties, as part of said
contract, and for consideration therein set forth, that neither the rmdersigned Contractor, nor any subcontractor

or materialman, nor any other person furnishing labor or materials to the Contractor under the subject contract
shall file a lien for work performed, or materials furnished to the building or any part thereof.
The General Contractor hereby agrees to waive any defects in the filing and indexing of this lien waiver
in the Office of the Prothonotary where it is to be filed pursuant to Section 1402 of the Mechanics' Lien Law
of 1963, and agrees that it will not contest the validity of the lien waiver based upon any such defect, and
hereby agrees to this waiver of defects on behalf of any of the subcontractors, materialmen, or suppliers that
may provide any labor or material under the General Contractor's agreement with the Owner and who, but for
the same waiver, would be entitled to assert mechanics' liens against the Owner's property under the
Mechanics' Liens Law of 1963.
