FOLLMER EXCAVATING, INC., Contractor IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NUMBER O2-¢P~/"/ K~[:) TERM, 2002 JORICH LAND DEVELOPMENT CORPORATION, a Pennsylvania business corporation with its registered office at 1620 Mountain Road, Dauphin, Pennsylvania, hereinafter called "Owner", as assignee by assignment dated February 18, 2002 by Daniel K. Jorich, Sr. of Daniel K. Jorich Sr.'s rights and obligations under a certain contract by and between Daniel K. Jorich, Sr. and Follmer Excavating, Inc., has entered into said contract with FOLLMER EXCAVATING, INC., a Pennsylvania Corporation with its principal place of business at 6 Summer Drive, Dillsburg, Pennsylvania, hereinafter called "Contractor", for installation and construction of municipal improvements including sanitary and storm water systems, streets, water and other municipal improvements upon land of Owner situate: East Pennsboro Township, Cumberland County, Pennsylvania, being more particularly bounded and described on Exhibit "A," attached hereto and made part hereof. NOW, February 19, 2002, before any authority has been given by the said Owner to the said Contractor to commence work on the said improvements or purchase materials for the same, in consideration of the making of the said contract with Owner and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against said municipal improvements or the property by the Contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the installation and construction of said municipal improvements, the right to file such liens being expressly waived. 012741-00001/2.18.02/RMW/DM/154882.1 WITNESS, our hands and seals the day and year aforesaid. (SEAL) 012741-00001/2.18.02/RMW/DM/154882.1 EXHIBIT "A' ALL THAT CERTAIN tract or parcel of land and premises situate, lying and being in the East Pennsboro Township, Cumberland County, Pennsylvania, more particularly described as follows: BEGINNING at a point on the southem right-of-way line of a 15 foot unopened alley at the northwest corner of lands N/F Dale A. Clemens and Mildred A. Clemens; thence along the western line of said Clemens land, South 33 degrees 28 minutes 24 seconds East a distance of 326.82 feet to a point on the western right-of-way line of a 5 foot unopened alley at the corner of land N/F Pine Crest Holding Co.; thence along the northern line of said Pine Crest Holding Co. land, South 64 degrees 47 minutes 00 seconds West a distance of 358.61 feet to a point at the southeast corner of land N/F Peter D. Marino and Stacey L. Marino; thence along the eastern line of said Marino land, North 25 degrees 27 minutes 21 seconds West a distance of 386.90 feet to a point on the southern right-of-way line of a 15 foot unopened alley, at the northeast comer of said Marino land; thence along the southern line of the said 15 foot unopened alley, North 76 degrees 14 minutes 21 seconds East a distance of 319.66 feet to a concrete monument at the northwest corner of land N/F Dale A. Clemens and Mildred A. Clemens, the point and place of BEGINNING. The forgoing legal description is in conformance with the Final Land Development Plan of Locust Woods, dated February 7, 2001, last revised November 5, 2001, prepared by Act One Consultants, Inc., Job Number 00-152, to be recorded in the Office of the Recorder of Deeds of Cumberland County.
