Mirza and Bushra N. Mirza WHEREAS, of Camp Hill is about to execute contemporaneously herewith, a contract, with Fogarty Homes, Inc. of Harrisburg for the erection of a . Pennsylvania Pennsylvania, two- story Pennsylvania. building upon a lot of land situate see Attached Schedule A NOW. Zamir A. &Bushra N. Mirza. at the time of and immediately before the execution of the prin- cipal contract, and before any authority has been given by the said ~]fg]fX}{~t~i]{~XXl{~]f Zamir A. 0~%?, and Bushra N. Mirza to thesaid Fogarty Homes, Inc. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Fogarty Homes, Inc. and the further consideration of One Dollar, to Fogarty Homes, Inc. paid by Zamir A. and Bushra N. Mirza , it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. SIGNED AND SEALED IN THE PRESENCE OF ~~ File No. 02-120 Exhibit "A" All That Certain lot or piece of land situate in East Pennsboro Township, Cumberland County, Pennsylvania, bounded and described according to a certain Final Plan of Penn Valley, prepared by Hartmen & Associates, Inc., Engineers and Surveyors, Camp Hill, Pennsylvania, more particularly described as follows, to wit: Beginning at a point on the southern right-of.way line of Blue Spruce Drive (50' wide) at the dividing line between Lots #37 and #38 as shown on the hereinafter mentioned plan; thence along the right-of-way line of Blue Spruce Drive, North 80 degrees 14 minutes 45 seconds East a distance of 70 feet to a point; thence by a curve, curving to the right having a radius of 25.00 feet and an arc length of 39.27 feet to a point on the western right-of-way line of Elm Drive (50 feet wide); thence along the western right-of-way line of Elm Drive South 09 degrees 45 minutes 15 East, a distance of 75.00 feet to a point at the dividing line between Lot #38 and Lot #60, Plan of Phase III recorded in Plan Book 78, Page 114; Thence along the dividing line between Lot #38 and Lot #60 South 80 degrees 14 minutes 45 seconds West a distance of 95.00 feet to a point at the dividing line between Lots #37, #38, #60 and #61; thence along the dividing line between Lots #37 and #38, North 09 degrees 45 minutes 15 seconds West a distance of 100.00 feet to a point southern right-of-way line of Blue Spruce Drive, said point being the place of BEGINNING. Being Lot No. 38 on the Final Subdivision Plan of Penn Valley, Phase III, recorded in Plan Book 82, Page 67, and containing approximately 9,365.87 square feet, more or less. BEING THE SAME PREMISES which LOGAN'S RUN ASSOCIATES, INC., A PA GENERAL PARTNERSHIP by Deed dated February 11, 2002 and intended for immediate recording in the Office of the Recorder of Deeds in and for Cumberland, Pennsylvania, granted and conveyed unto ZAMIR A.
