AND NOW comes your Petitioner, Linda K. Spagnolo, who files t�s�``Motion�,i� Ma`ke�
Citation Absolute and, in support thereof, avers as follows:
1. On or about Apri123, 2013, your Petitioner filed a Petition to Authorize the
Register of Wills to grant Letters Testamentary D.B.N. after twenty-one (21)years from
Decedent's death.
2. On Apri130, 2013, a Citation was issued by the Court to be served on all
interested parties to show cause, if any they had, why the Estate should not be opened pursuant to
the petitioner's Motion.
3. Petitioner served the Citation together with a copy of the Petition on all persons of
interest and has filed Proofs of Service with the Register of Wills. Time stamped and certified
copies of the Proofs of Service filed with the Register of Wills are attached hereto, made a part
hereof, and marked Exhibit"P.1."
4. The Citation provided that all parties in interest were to file any objections to the
opening of the Estate within twenty(20) days of the date of service of the Citation upon them.
5. Twenty(20) days have passed since the service of the Citation on all parties in
interest and none of the parties in interest who were served with the Citation have filed
objections to the opening of the Estate.
WHEREFORE,your Petition respectfully requests this Court to enter a Rule Absolute
allowing Linda Spagnolo to receive Letters Testamentary as Administratrix of the Estate of
Robert F. Bates.
