WHEREAS, John E. Clarke of 126 N. 26th Street, Camp Hill, PA 17011, is abogt toexecute
contemporaneously herewith, a contract, with Tiday Property Management, LLC of 2 W.
Mulberry Hill Road, Carlisle, PA, for the erection of a building upon premises commonly
known as 24 Windswept Way, Township East Pennsboro, Cumberland County,
Pennsylvania, as set forth in the deed dated 01/22/88, recorded at Deed Book D -33, Page
952 (part of), in the Recorder's Office for Cumberland County, Pennsylvania, as more
specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, August 28, 2013, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with Contractor and the further consideration of One Dollar
($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the
building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hands and seals the day and year aforesaid.

EXHIBIT
ALL THAT CERTAIN piece or parcel of land situate in East Pennsboro Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point located on the southern right -of -way line of Windswept Way at the dividing
line between Lots G1 and F29 on the hereinafter referenced Plan; thence along the eastern boundary line of
Lot G1, South 13 degrees 11 minutes 00 seconds East, a distance of 150.00 feet to a point on the northern
boundary line of Open Space on said Plan; thence along said Open Space, North 60 degrees 04 minutes 50
seconds East, a distance of 21.3.23 feet to a point along the western line of Lot F 14 of Floribunda Heights,
Phase I, Section 10.A; thence along the western boundary line of Lot F14., North 17 degrees 46 minutes 45
seconds West, a distance of 100.00 feet to a point being the southeast corner of Lot F28 on hereinafter
referenced Plan; thence along said southern boundary line of Lot F28, North 88 degrees 02 minutes 00
seconds East, a distance of 150.00 feetto apoint along the cul -de -sac right -of -way line of Windswept Way;
thence along Windswept Way, by a curve to the right, having a radius of 50.00 feet and an arc length of
68.75 feet to a point, the point and place of BEGINNING.
BEING Lot F29 on the Final Subdivision Plan of Floribunda Heights, Phase I, Section 10..B and
recorded in the Cumberland County Recorder of Deeds Office at Instrument No. 201200886.
CONTAINING 28,320 square. feet or 0.65 acres.
UNDER AND SUBJECT, NEVERTHELESS, to a snow dump easement and a 30' wide sanitary
sewer easement along the Western boundary line of the herein Lot.
ALSO UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances
and other matters of record or that which a physical inspection or survey of the premises would reveal.
