PETITION FOR A RULE TO SHOW CAUSE WHY AN ORDER
GRANTING WAGE ATTACHMENT SHOULD NOT ISSUE
AND NOW, comes the Plaintiff, Bent Creek Limited Partnership, and hereby petitions
the Honorable Court to issue a Rule to Show Cause as to why relief in the instant Petition should
not be granted upon the Defendant, Justin Gift and the Defendant's employer, Amazon.com,
P.O. Box 81226, Seattle, W A 98108, in support thereof avers as follows:
1. This matter arises out of a dispute concerning a residential lease.
2. Judgment was entered against the Defendant by District Justice Thomas A. Placey,
Magisterial District 09-3-04 on October 14, 2004 in the amount of $2,956.60, Docket
Number CY-0000545-04. Post judgment costs increased this amount to $3,057.60,
which is shown on the certified judgment.
3. The District Justice Judgment was filed with this Court on November 22,2004, under
Docket Number 04-5870 civil term.
4. The Defendant is currently employed at Amazon.com, P.O. Box 81226, Seattle, WA
98108
5. Pursuant to 42 Pa. C.S.A. Section 8127, the Plaintiff is entitled to garnish 10% of the
net wages per pay period of the Defendant, this judgment debtor-tenant.
6. The Plaintiff requests that this Court issue an order attaching the wages of the
Defendant to satisfy the judgment, as permitted by 42 Pa. C.S.A. Section 8127.

7. Copies of the District Justice Judgment and the proposed attachment order are
attached hereto.
WHEREFORE, the Plaintiff hereby requests that the Honorable Court issue the proposed
rule to show cause against both the Defendant, Justin Gift and his current employer,
Amazon.com, P.O. Box 81226, Seattle, WA 98108.

AND NOW, Pursuant to Pennsylvania Rule of Civil Procedure 206.7, Plaintiff,

in support of same avers as follows:
1. Rule to Show Cause was granted against Defendant on February 8, 2006.

ANSWER TO RULE TO SHOW CAUSE
On February 8, 2006, the Court issued a Rule to Show Cause regarding Bent Creek
Limited Partnership's Petition for a Wage Attachment ofJustin Gift. In response, Amazon.com,
incorrectly identified as Mr. Gift's current employer, states:
1. Amazon.com is without knowledge or information regarding Justin Gift's
residential lease.
2. This paragraph contains conclusions oflaw to which the Pennsylvania Rules of
Civil Procedure require no response. To the extent a response is required, the allegations in this
paragraph are denied.
3. Admitted.
4. Denied. Mr. Gift was never an Amazon.com employee. Mr. Gift worked for a
temporary staffing company called Integrity Staffing. Between September 30, 2005 and October
3,2005, Mr. Gift worked as a temporary employee at Amazon.com's Lewisberry facility.

Between October 3, 2005 and November 21, 2005, Mr. Gift worked in Amazon.com's Carlisle
facility. Mr. Gift's assignment at Amazon.com ended on November 21, 2005.
5. This paragraph contains c<;>nc1usions oflaw to which the Pennsylvania Rules of
Civil Procedure require no response. To the extent a response is required, the allegations in this
paragraph are denied.
6. It is admitted that Plaintiff purports to proceed as stated therein.
7. Denied. Amazon.com did not receive a copy of the District Justice Judgment or
the Proposed Attachment Order in this matter.
WHEREFORE, Amazon.com respectfully requests that this Court deny Plaintiffs
request for a wage attachment against Justin Gift insofar as any such order affects Amazon.com.
