$120,000.00, with 4.5% interest, for five years from the present date first above written, then to
current prevailing rate PROVISO: said rate of interest shall not exceed 7 %. The term of said
Note is 15 years from the present date first above written.
AND FURTHER, I, CLAYTON MURRAY, do hereby authorize and empower any attorney of
any Court of Record of Pennsylvania or elsewhere to appear for and to enter judgment against
me, Clayton Murray, and in favor of Frank Kindler, or any bona fide holder of this Note for the
above sum with the same terms as aforesaid, costs of suit, release of errors, without stay of
execution, and with .5 % percent added as a reasonable attorney's fee and I hereby waive and

AFFIDAVIT
I, CLAYTON MURRAY, being duly sworn according to law, the undersigned deposes and
says:
1. 1 am borrowing funds from Frank Kindler.
2. 1 am over 21 years of age, not within the military service of the United States and its allies nor
otherwise within the civil relief provisions of the Soldiers and Sailors Civil Relief Act of 1947 as
amended.
3. 1 have agreed to borrow the funds from Frank Kindler, the Lender, in the principal
amount of $120,000.00 and to secure said obligation have delivered to Frank Kindler,
the Lender, a JUDGMENT NOTE, containing a Confession of Judgment.
4. 1 understand that a confession of judgment allows for the entry of a judgment by confession
against me and that said judgment encumbers real estate situate at 745 Hummel
Avenue, Lemoyne, PA., 17043.
5. The loan is for commercial purposes in that the proceeds are being used by me for the
purchase of real estate and not for personal, family, or household use.
