WHEREAS, JOHN R. HAUPT and AMY L. HAUPT, HUSBAND AND WIFE of 155 TIMBER LANE,
SHIPPENSBURG, PENNSYLVANIA 17257, is about td execute contemporaneously herewith a contract with
ADAMS & BREAM BUILDERS, LLC of , for the erection of a ~_, story building
upon a lot of land situate
SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PURPOSES
NOW, NOVEMBER 22, 2004, at the time o~ and immediately before the execution of the principal
contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to
commence work on the said building, or purchase materials for the same in consideration of the making of
the said contract with OWNER and the further consideration of one Dollar, to CONTRACTOR paid by
OWNER it is agree that no lien shall be filed against the building by the contractor, or any subcontractor,
nor by any of the mate"iai men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.

ALL THAT CERTAIN lot or parcel of real estate lying and being situate in
Shippensburg, North Newton Township, Cumberland County, Pennsylvania,
more particularly bounded and described as follows:
BEGINNING at a set iron P.K. nail in Ritner Highway (SR-0011) at the
easternmost corner of the tract herein descrilbed; thence continuing in
Ritner Highway and with Lot No. 6, South 50 d,~grees 05 minutes 40 seconds
West 235.87 feet to an existing fence P.K. nail; thence with Lot No. 1
through an existing P.K. nail on line, North 39 degrees 52 minutes 44
seconds West 273.98 feet to an existing iron ]pin; thence continuing with
Lot No. 1, South 50 degrees 07 minutes 47 seconds West 175.01 feet to an
existing iron pin; thence with Lot No. 3, Nor~h 47 degrees 45 minutes 04
seconds West 1,308.23 feet to a set iron pin; thence with lands now or
formerly of Donald VanScyoc, North 40 degrees 34 minutes 23 seconds East
339.00 feet to a set concrete monument; thence with lands now or formerly
of R. Craig Fulton, South 49 degrees 01 minute 21 seconds East 510.60
feet to an existing fence post; thence by the same South 48 degrees 43
minutes 32 seconds East 1,135.42 feet to a set P.K. nail in Ritner
Highway, the place of BEGINNING.
BEING Lot No. 2 on that Final Subdivision Plan for Harry Ho Fox, Jr. as
prepared by Eric L. Diffenbaugh, Profession Land Surveyor as approved by
the North Newton and South Newton Board of Supervisors and recorded in
Cumberland County Plat Book Volume 89, Page 13 et.sec.
BEING THE SAME PREMISES which Harry H. Fox, Jr., conveyed unto John R.
Haupt and Amy L. Haupt, husband and wife, by deed dated August 11, 2004
and recorded August 18, 2004 in the Recorder's Office in and for
Cumberland County, Pa. in Record Book 264, Pa~e 3767.
