AND NOW, this day of September, 2013, upon consideration of the claim
filed by Edythe M. McClain and after thorough consideration of the pleadings,
prehearing memorandums and the pertinent case law, the parties having agreed to
submit this case to the court without a hearing, we find that Claimant has not met her
burden to prove the claim by providing clear, direct, precise and convincing evidence.
Accordingly, the claim of Edythe M. McClain is DISMISSED.
