Ensminger Builder, Inc. · IN THE COURT OF COMMON PLEAS · CUMBERLPdND COUNTY, PENNSYLVANIA WHEREAS, Paul Beitler and Virginia Sloss, 20 Round Hill Road, Apt. 1, Camp Hill, PA 17011 are about to execute contemporaneously herewith, a contract/agreement, with Ensminger Builder, Inc., 1223 East Chocolate Avenue, Hershey, PA 17033, for the construction of a residential building upon premises commonly known as 55 Old Farm Road, Country, Lot g425, Club Park, Camp Hill, Hampden Township, Cumberland County, Pennsylvania set forth in the deed dated November 6, 2003, and recorded November 14, 2003, at Deed/Record Book 260, Page 1687, in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and at~:ached hereto. NOW, November 29, 2004, at the time of and immediately before the execution of the principal contract/agreement, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollm' ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or material s purchased, or extra labor or materials purchased for the erection of improvements on said building, the right to file such liens being expressly waived. By: ~ ~ ~AKE ENSMINGER, ~ rl~e '~cnt PAUL BEITLER By: Vi RGi Ni A~SS~L/]O<~i,~~ EXHIBIT A LEGAL DESCRIPTION ALL THAT CERTAIN piece or parcel of land, situate in the Township of Hampden, CoUnty of Cumberland and State of Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the Southern line of Old Farm Road, which point is at the dividing line between Lots Nos. 425 and 426 on Plan of Lots hereinafter mentioned; THENCE South 40 degrees 35 minutes 43 seconds West and along the dividing line between Lots Nos. 425 and 426 on Plan of Lots hereinafter mentioned, a distance pf 139.01 feet to a point at other lands now or late of Howard C. Gale Development Co., Inc.; THENCE North 29 degrees 35 minutes 00 seconds West and along line of other lands now or late of Howard C. Gale Development Co., Inc., a distance of 251.48 feet to a point at the dividing line between Lots Nos. 425 and 424 on Plan of Lots hereinafter mentioned; THENCE South 76 degrees 29 minutes 03 seconds East and along the dividing line between Lots Nos. 425 and 424 on Plan of Lots hereinafter mentioned, a distance of 189.35 feet to a point on the Western line of Old Farm Road; THENCE Southwardly and on a curve to the right whose radius is 60 feet and along the Western line of Old Farm Road, an arc distance of 90 feet to a point, the point and place of BEGINNING. BEING Lot No. 425 on Plan of Lots known a Part of Country Club Park whioch Plan is recorded in the Office of the Recorder of Deeds in and for Cumberland County in Plan Book 63, Page 9. BEING the same premises which Howard C. Gale Development Co., Inc. by their deed dated June 6, 1994 and recorded in the Cumberland County Recorder of Deeds Office in Book 106, Page 927, granted and conveyed unto Ronald M. Katzman and Marjorie C. Katzman, his wife, Grantors herein.
