AFFIDAVIT OF ESTABLISHMENT OF ACCOUNTS
We, Patricia A. Toyas, George N. Toyas and Jeffrey C. Goss, Esquire hereby
being duly sworn according to law, upon their oath depose and say that:
1. Patricia A. Toyas, George N. Toyas and Jeffrey C. Goss, Esquire are the
duly appointed Guardians of the Estate of Nicholas L. Toyas, a minor (the "Estate").
2. By Order dated November 5, 2012, the Court granted the Guardians sixty
(60) days to file proof of the establishment and funding of restricted and FDIC
insured accounts for funds received by the Estate for settlement of a medical
malpractice action in the courts of the state of New York.
3. Guardians were forced to request two extensions of time to file proof of
establishment of accounts as a result of a delay in the approval of the settlement by
the New York State Supreme Court (Queens County).
4. By Order dated March 4, 2013, this Court ordered proof of the
establishment of the accounts within thirty days of the receipt of the settlement
, funds or no later than September 4, 2013.
5. By Order dated July 29, 2013, this Court permitted the Guardians to
deposit funds into NCUA insured accounts as well as FDIC insured.
6. The Guardians have established five (5) accounts, each containing less
than $250,000, at the following financial institutions: Orrstown Bank, Susquehanna
Bank, Metro Bank, Member's First Credit Union and AmeriChoice Federal Credit
Union.
