PETITION UNDER SECTION 3102 � " � �� " OF THE PROBATE, ESTATES AND FIDUCIARIES CODE FOR THE SETTLEMENT OF A SMALL ESTATE . TO THE HONORABLE JUDGES OF SAiD COURT: 1. Your Petitioner, Bonnie L. Kreiger, is an adult individual who resides at 105 Hickory Road, Carlisle, Cumberland County, Pennsylvania. 2. No judge has been assigned to this case. 3. The decedent is Alan H. Thrush, who died on May 17, 2013. 4. The petitioner is the decedent's sister. 5. The decedent was not married at the time of his death and the decedent had no children. 6. Petitioner was appointed administrator of the decedent's estate by the Register of Wills of Cumberland County on May 31, 2013. 7. The decedent's last residence was 720 North Front Street, Lemoyne, Pennsylvania 17043. The decedent owned this real estate subject to a mortgage of Metro Bank, N.A. 8. Petitioner conducted an auction of decedent's personal property at which time the real estate was offered for public sale. 9. The real estate owned by decedent did not sell at auction despite numerous advertisements and marketing in advance of the auction by Chuck Bricker, the licensed auctioneer who conducted the public sale. 10. Since the date of the auction the petitioner has continued to market the property and has received and offer from a third party in an arm's length transaction for a sale price of$136,000.00. 11. The mortgage payoff on the property is approximately $135,000.00 and after closing costs there will be insufficient funds to pay off the Metro Bank mortgage in full; Metro Bank will accept less than the full payoff to satisfy the mortgage resulting in a short sale. 12. The decedent's personal property was sold at auction with gross proceeds realized in the amount of$12,293.00 less costs of sale of$1,775.00 resulting in net proceeds of$10,518.00. 13. The decedent had funds on deposit at Americhoice Federal Credit Union but decedent had a credit account through Americhoice which exceeded the balance of the deposit account so no funds will be received by the estate from Americhoice. 14. The decedent had a deposit account at Sovereign Bank with a date of death balance of$2.94. 15. Total assets for distribution total $10,700.14. 16. The Petitioner will file a Pennsylvania lnheritance Tax Return which indicates that no inheritance tax is due since the estate is insolvent. 19. Section 3392 of the Probate, Estates and Fiduciary Code directs the payment of the administrative expenses of the estate and the funeral bill prior to paying creditors in the estate. WHEREFORE, your Petitioner prays that an Order authorizing payment of the administrative expenses from the decedent's assets and that no distribution be made to unsecured creditors due to the insolvency of the estate.
