Fritz, Trustees of the Trust established under the Last Will and Testament of Walter Terry Eichelberger and created for the benefit of Benjamin B. Eichelberger and Nicholas E. Eichelberger, all hereafter known as RELEASORS; AND: Judy B. Eichelberger, Executrix of the Estate of Walter Terry Eichelberger, hereafter known as RELEASEE. WHEREAS, Walter Terry Eichelberger, late of Southampton Township, Cumberland County, Pennsylvania, died on September 25, 2008, testate; and WHEREAS, Letters Testamentary were granted on October 3, 2008, by the Register of Wills, Cumberland County, Pennsylvania, to Judy B. Eichelberger, to Estate File No. 21-08-0990, and duly advertised in the Cumberland Law Journal and The Sentinel, and WHEREAS, the parties hereto have had any and all questions answered to their satisfaction during the course of the administration of this estate and have no present questions or concerns whatsoever; and WHEREAS, based on the above,the parties hereto wish to waive the filing of a formal First and Final Account and Schedule of Distribution with the Orphans' Court Division of the Court of Common Pleas of Cumberland County, Pennsylvania. NOW, THEREFORE, THIS INDENTURE WITNESSETH that, in order to facilitate the closing of the estate and to save the court fees and legal expenses which would be incurred by the filing of a formal First and Final Account and Schedule of Distribution with the Orphans' Court WEIGLE & ASSOCIATES, P.C. - ATTORNEYS AT LAW - 126 EAST KING STREET - SHIPPENSBURG, PA 17257-1397 l� Division of the Court of Common Pleas of Cumberland County, Pennsylvania, by the attorney for the estate, and in consideration of the settlement of the estate by the beneficiaries and trustees, the undersigned beneficiaries and trustees do hereby approve the settlement and do excuse Judy B. Eichelberger of and from any duty to file a formal First and Final Account and Proposed Schedule of Distribution with the Orphans' Court Division of the Court of Common Pleas of Cumberland County, Pennsylvania, or in any other jurisdiction; the undersigned do further release, remise, quitclaim and forever discharge Judy B. Eichelberger of and from all liabilities, suits, actions, claims and Demands for or by reason of her administration of the Estate of Walter Terry Eichelberger. WITNESS r d Ben min B.
