HomeMy WebLinkAbout04-6076 STIPULATION AGAINST LIENS THIS AGREEMENT made the ~day of '~/~/~---~g::;~~nd between YINGST HOMES, INC. Contractor, AND Charles G. Gray and Barbara A. Gray, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in 1008 Jenkins Grove, Enola, East Pennsboro Township, Cumberland, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to contractor in hand paid b'.t Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account c,f any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Gray (Seal) LT-- ¥O0 ALL THAT CERTAIN lot or tract of land situate in East Pennsboro Township, Cumberland County, Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point western dedicated right-of-way line of Jenkins Grove at the dividing line of Lot #~48 and Lot #47; thence by line of Lot #48 North 65 degrees 12 minutes 19 seconds West 95.00 feet to a point; thence by line of Lot #38, Whelan Crossing Phase IX North 24 degrees 47 minutes 41 seconds East 67.54 feet to a point; thence by same North 07 degrees 41 minutes 21 seconds East 23.50 feet to a point at the dividing line of Lot #-46 and Lot ~47; thence by line of Lot #-46 South 65 degrees 12 minutes 19 seconds East 101.91 feet to a point on the western right-of- way line of Jenkins Grove; thence by said right-of-way line South 24 degrees 47 minutes 41 seconds West 90.00 feet to a point at the dividing line of Lot #48 a~nd Lot #47, the place of BEGINNING. CONTAINING 8,628 square feet. BEING Lot ~47 as shown on the Final Subdivision Plan for Whelan Crossing, Phase X[. Recorded in Plan Book 85, Page 40. BEING SUBJECT TO half of a 25 foot wide Drainage Easement as shown on the above mentioned subdivision plan. ALSO BEING SUBJECT TO other conditions and restrictions set forth on the above mentioned Subdivision Plan. BEING THE SAME PREMISES which Whelan Associates, L.P., Richard E. Yingst, Jr., sole General Partner, Janet R. Young and David L. Young, husband and wife, Kathleen A. Rittner, single woman by her Attorney-in-Fact Janet Rittner Youn, by deed to be recorded simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Charles G. Gray and Barbara A. Gray.
