I, JUN~ A. SWANGER, of the Township of M~nroe, County of Cumber-
land and State of Pennsylvania, being of sound and disposing mind, memory
and understanding, do make, publish and declare this my Last Will and Testa-
merit, hereby revoking and making void all former Wills by me at any time
heretofore made.
I direct the payment of all my just debts and ~al expenses
as soon after my decease as the same may conveniently be done.
Ail the rest, residue and ranainder of my estate, real, personal
and mixed, of whatsoever nature and wheresoever tbm same my be situate, I
give, devise and bequeath to my husband, RICHARD L. SWANGER, absolutely and
unconditionally.
In the event my said husband should predecease me, or die within
thirty (30) days of my death, then I give, devise and bequeath my entire es-
tate, real, personal and mixed, whatsoever and wheresoever situate, to my
children, in equal shares.
LASTLY, I nominate, constitute and appoint my husband, RICHARD L.
SWANGER, Executor of this, my Last Will and Testanm~t, and in the event he
should predecease me, or should he be unable or unwilling to serve in such
capacity for any reason, then I nominate, constitute and appoint my daughter,
SUSAN D. STONER, Executrix of this, my Last Will and Testmmmnt, in his place
and stead.

PETITION TO ESTABLISH DEATH OF ABSENTEE WITHOUT THE APPOINTMENT
OF A MASTER IN ACCORDANCE WITH 20 Pa. C.S. § 5701
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
The Petition of Susan D. Stoner states that:
1. Petitioner is the sister of Richard Lee Swanger, Jr., a presumed decedent.
The last known residence of Richard Lee Swanger, Jr., was R.D. #1, 8270
Bull Road, Lewisberry, Pa 17339.
Richard Lee Swanger, Jr., left his residence in October 1988, and has been
absent and unheard of since that date and Petitioner believes him to be dead.

The circumstances attending the disappearance and continued absence of
Richard Lee Swanger, Jr. are these:
Richard Lee Swanger, Jr. went fishing for a couple of weeks in the
Autumn of 1988. During that time he left his dog with his
grandmother, Mabel McCarty (now deceased). He returned in
October 1988 and left soon thereafter for parts unknown. Records
maintained by Mabel McCarty, deceased, indicate she may have
traced him to Florida to fish, then on to Mexico. He left with his dog
and has not been seen since that time. Notice of Mabel McCarty's
death mailed to Richard Swanger, Jr. was returned undelivered.
The presumed decedent is survived by Petitioner Susan D. Stoner, his sister,
and by her children, Megan Stoner and Nicholas Stoner, presumed
decedent's niece and nephew.
6. Petitioner believes and avers that the presumed decedent left no will.
7. The presumed decedent's estate consists of the following:
a life insurance policy with Zurich Life, Account No. 0317127,
with a value of $10,000.00.
a life insurance policy with Met Life, Account No. 18892511,
with a value of $1,200.00.
c. 1/2 the value of an IRA valued at approximately $4,000.00; and
do
1/2 the value of the death benefit of an insurance policy on his
mother June Swanger, who died on March 25, 2002, with a
value of $5,300.00.
e. 1/2 of the estate of June Swanger.
a $15,000.00 bequest from presumed decedent's grandmother,
Mabel P. McCarty, which bequest is currently held in trust
and shall automatically pass to Megan Stoner and Nicholas
Stoner if presumed decendent does not claim the bequest
within twenty (20) years of the date of Mabel P. McCarty's
date of death, being July 20, 1997.
8. Petitioner knows of no other property.
9. 20 Pa. Cons. Stat. § 5704 requires that the Court Order advertisement of a
hearing on the Petition, a proposed Order for which is attached hereto as Exhibit A.
WHEREFORE, Petitioner requests that the Court:
Set a hearing date for the purpose of declaring Richard Lee Swanger, Jr. a
presumed decedent.
Order the advertisement of the filing of the Petition and the hearing date
thereon in the form attached to the Petition in one newspaper of general
circulation in Lewisberry, the last city of residence of Richard Lee Swanger,
Jr. and in the York Daily Record, York, Pennsylvania, weekly for four
successive weeks, the last appearance of which shall be at least two weeks
before the hearing.
