MECHANIC'S LIEN CLAIM
Claimant, Jeffrey L. Haldeman, t/d/b/a J. L. Haldeman Landscape
Construction, through the undersigned counsel, files this claim
against the improvements and property at 4004 Glenfinnan Place,
Mechanicsburg, Lower Allen Township, Cumberland County,
Pennsylvania, and more particularly bounded and described in
Cumberland County Book 248, Page 15, for the payment of a debt
due to Claimant as a contractor for labor, equipment, and
materials furnished by Claimant and the erection and
construction of a swimming pool, concrete deck, and related
landscaping at an existing house. In support of the claim, the
Claimant makes the following statement:
1. The owners of the property are Timothy J. Morrison and
Tonya A. Morrison, his wife, with an address at 4004 Glenfinnan
Place, Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. The improvement to the above-described property were
effected at the request of the said Timothy Morrison and Tonya
Morrison to construct a swimming pool, a concrete deck, and
related landscaping on the subject premises.
3. The labor and materials for which the debt is due were
to be furnished for the agreed sum of $32,600.00, pursuant to
written contracts with the owners dated May 24, 2004 and May 27,
2004, copies of which are attached hereto and incorporated
herein by reference as though fully set forth.

5. Claimant installed the footers pursuant to the
contracts, but Owners refused to pay the next installment of
$8310.00, despite repeated demands from Claimant.
6. Claimants purchased all materials needed to complete
construction, some of which are custom-designed, making them
useless for other projects.
7. When Owners refused/failed to pay the next installment,
Claimant ended its work at the property on August 9, 2004, which
is less than four (4) months prior to the filing of this claim.
8. Claimant has been paid $18,500.00 toward the debt due
Claimant for the stated labor, equipment, and materials.
9. Owners owe Claimant $8310.00 for work completed on the
contract and Claimant makes a claim for $8310.00.

COMPLAINT
1. Claimant/Plaintiff is Jeffrey L. Haldeman, t/d/b/a J.
L. Haldeman Landscape Construction, with an address of 318
Falling Springs Road, Landisburg, Pennsylvania, 17040.
2. Owners/Defendants are Timothy J. Morrison and Tonya A.
Morrison, his wife, with an address at 4004 G1enfinnan Place,
Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. Plaintiff filed a mechanic's lien claim on December 8,
2004, in the Court of Common Pleas of Cumberland County, as of
2004 Term, No. 04-6169, a copy of which is attached as Exhibit
"A."
4. Plaintiff alleged violations of two (2) written
contracts, copies of which are attached hereto as Exhibits ~B"
and "C."

Construction, through the undersigned counsel, files this claim
against the improvements and property at 4004 Glenfinnan Place,
Mechanicsburg, Lower Allen Township, Cumberland County,
Pennsylvania, and more particularly bounded and described in

4. Defendants admit that Plaintiff alleges the breach of two contracts but deny
that they breached the contracts, To the contrary, Plaintiff breached the contract by

i failing to deliver to the job site all of the materials required by the agreement and by

II refusing to provide further work on the project and abandoning the project in August of
2004. The averments set out in Defendants' New Matter and Counterclaim are
incorporated herein by reference,
5. Defendants admit that Plaintiff makes a claim for $8,310,00 but deny that that
claim is valid or that Plaintiff is owed that sum, or any other sum, by Defendants. The
averments set forth in Defendants' New Matter are incorporated herein by reference.

WHEREFORE, Defendants pray this court to dismiss Plaintiff's Complaint, to
dismiss the Mechanics Lien claim filed against Defendants' property, and to strike any lien
or notice of lien resulting from that Mechanics Lien claim.
NEW MAHER
By way of further answer, Defendants set forth the following New Matter:
6, The agreements between the parties required Plaintiff to supply and deliver to
Defendant's home all component parts of the pool and related systems to be installed at
Defendants' property upon receipt of the initial deposit by Defendants,
7, Plaintiff failed to perform its obligations under the contracts with Defendants in
the following ways:
A, Plaintiff failed to deliver all of the component parts of the pool and
related systems to Defendants' home as required by the agreement,
B. Plaintiff failed to proceed in a timely fashion with work under the
contracts.
C. Plaintiff performed some work in a shoddy and sub-standard way.
D, After demanding payments to which Plaintiff was not due, Plaintiff
announced to Defendants that he was terminating the contract and removed
himself, his workman, and all materials and parts from the Defendants'
residence.
E. Plaintiff refused to return to Defendant's home to complete the
project.
F. Plaintiff refused to return to the Defendants' home to take any
steps to protect the uncompleted pool from damage by weather or other
elements,
G, Plaintiff demanded that Defendants make payment to Plaintiff
which were not due and owing and withheld further work on the project until
the unearned payments were made by Defendants.
Each of these items constitutes a breach and violation of the agreements between the
parties.
8. As a result of Plaintiff's breach of the agreement between the parties,
Defendants owe Plaintiff no money whatsoever,

WHEREFORE, Defendants pray this court to dismiss Plaintiff's Complaint, to
dismiss the Mechanics Lien claim filed against Defendants' property, and to strike any lien
or notice of lien resulting from that Mechanics Lien claim.
COUNTERCLAIM
In addition to the above, the Defendants hereby assert the following counterclaim
against the Plaintiff in this matter:
