1, EUGENE R. HANSON, of Middlesex Township, Cumberl�and County,
Pennsyivania, being of sound and dispasing mind, memary ancN understanding, do
hereby make, publish and declare this as and for my last Wili �nd Testament,
hereby revoking aii other Wiiis and Codici{s heretofore made by me.
A. Pay a11 of my just debts, and funeral and buria! expenses {inciuding
the cost of a grave marker and family members' costs of travei to atte�nd my
funeral} as soan after my death as conveniently may be done. Pay a!! estate
administration expenses and all taxes imposed as a result of my death, including
any estate ar inheritance tax imposed on the transfer of my Nebraska farmland,
from the principai af my estate withaut appartionment.
B. To my trustees hereinafter named, i hereby give and devise all that
certain tract or parcei af land, consist+ng of 8Q acres, mare ar less, af�armland
owned by me in Gasper County, Nebraska, IN TRU5T, NEVERTHEI.ESS, upon the
following terms and canditions:
1. Trustees shaii maintain #he farm far use in agricultural production,
cantracting with a tenant farmer by such arrangement as Trustees, ir� their
discretian, may deem to be mast reasonable and appropriate for the dual
purposes of the productian ofi income and the preservatian af the fertility af the
land.
2. Trustees sha11 distribute all net incame, no less frequently than annually, as
follows: one quarter (1j4} to the Hope Lutheran Church of Smithfieid, NE, and
three eighths (3/8� to each af my daughters, for life.
3, After the death of one daughter, incame shall be distribu#ed, as follows: 1/4
ta the Hope Lutheran Church; 3j8 to my surviving daughter; and 3/8 to be divided
as fallows: one share for each of my then living grandchildren and one share for
the issue of each deceased grandchiid.
4. After the death of my remaining daughter, incame shall be distributed, as
follows: 1/4 tn Hope Lutheran Church and 3j4 to be divided as follaws: one sfiare
for each af my then {iving grandchildren and ane share for the issue o#each
deceased grandchild.
5. Upon the death of my last surviving grandchild who was alive at time of my
death, tfie farm shall be sold and the proceeds paid as follows: lJ4 to the Hope
Lutheran Church of Bertrand, NE; and 3/4 to be distributed as fallows: one share
for each of my Eiving great-grandchildren, and one share for the living �ssue of
each deceased great-grandchild.
D. i give and bequeath my collection of histarica! artifacts to such
museum{s) andfor historical society or other gavernmental or public rion-profit
institution(s} as my executars shali seiect.
E. Ail the rest, residue and remainder of my estate ! give, devise and
bequeath to my daughters, Kathryn L. Johnson end Kristine l. Kraft, in equai
shares, perstirpss.
F. I appaint my daughters, Kathryn L.Johnson and Kristine L. Kraft, to
serve as my executars.
G. k appaint my daughters, Kathryn l.Johnsan and Kristine t. Kraft, and
the survivor of them, to serve as Trustee(s} af my Farmland Trust. Upon the
death, incapacity or resignation of both af my said daughters, the old�st surviving
child of each of my said daughters shali serve as successor Co-Trustees. Upon the
death, incapacity ar resignation of both af said successor Trustees, my
grandchildren then (iving shall each have ane vote and Hape Lutheran Church
shall have one vote in the election or appointment of a successor trus;tee. A
retentian vote shall be conducted annua{!y during the month of January, If the
majority vate to retain the successor trustee so elected, s/he shall serve for an
additianal year. Otherwise, a replacement trustee shall be elected by the
procedure set forth above.
H. No executor, trustee or other fiduciary acting under this instrument
shall be required to give bond for the faitnful performance of his, her or its duties
in this or any other jurisdiction.
