CML ACTION
1. Plaintiff Midland Credit Management, Inc. successor in interest to Household
Automotive Finance Corporation is a corporation duly organized and existing under the laws
of the State of Kansas with offices located at 5775 Roscoe Court, San Diego, California
92123.
2. The Defendant(s) Maynard Neal is/are individual(s) residing at addressees)
contained in caption of this case.
3. On or about June 13, 2002, Defendant(s) (buyer) entered into a written
Pennsylvania Motor Vehicle Installment Contract (hereinafter called the Contact) to
purchase a 'Vehicle" from dealer (creditor) as fully described in said Contract, said purchase
to be made according to the terms, prices and conditions contained the aforesaid Contract,
a true and correct copy of said contract being attached hereof, made a part hereof and
marked Exhibit "A".
4. "Creditor" subsequently assigned the aforesaid Contract to Household Automotive
Finance Corporation.
5. Subsequently, Defendant(s) did default upon the aforesaid Contract by failing to
make timely instalment payment to Plaintiff and in accordance therewith the entire
remaining balance became due and payable immediately.
6. The aforesaid Contract further provides that in the event of default, Plaintiff may
repossess the 'Vehicle" and sell same in accord with the terms of the aforesaid Contract.
7. The aforesaid Contract further provides that buyer agrees to pay lawyers fees and
legal costs permitted by law.
8. Household Automotive Finance Corporation set over unto Plaintiff all of its right, title
and interest on and to its account with Defendant(s) so that the Plaintiff is now the owner
of said account.
9. As a consequence of the foregoing there is presently due and owing to Plaintiff by
Defendant(s) the following sum(s):
Unpaid balance:
$10,746,31
Interest:
1,128.36
Attorney fees:
2,374.93
Total due:
$14,249.60
10. Despite repeated demand by Plaintiff, Defendant(s) has/have failed and refused to
pay the aforesaid sum.
WHEREFORE, Plaintiff demands that judgment be entered against Defendant(s) in
favor of Plaintiff in the amount $14,249.60 together with interest and costs.
