COMPLAINT IN CIVIL ACTION AND NOW COMES, Plaintiff by and through its counsel, WELTMAN, WEINBERG & REIS, CO., L.P .A., and hereby files this Complaint against Defendant. In support thereof, Plaintiff avers as follows: 1. Plaintiff, Progressive Northwestern Insurance Company ("Progressive"), is a corporation with a registered office located at P.O. Box 89480, Cleveland, Ohio. 2. Defendant, Crystal Palmer, is an adult individual who at all times pertinent hereto resided at 70 Lebo Road, Carlisle, Pennsylvania 17013. 3. Progressive issued a policy of insurance whereby Progressive agreed to insure a 2000 Honda Civic LX ("Insured Vehicle"), owned by Plaintiffs insured. 4. At all times mentioned herein, Progressive's insured was the owner of said Insured Vehicle. 5. On or about December 5, 2003 a motor vehicle owned and operated by Defendant, Crystal Palmer, did negligently and carelessly strike the Progressive Insured's motor vehicle at or near the intersection of Walnut Bottom Road and Locust Lane, Carlisle, Cumberland County, Pennsylvania. 6. As a direct and proximate result of Defendant's negligence and carelessness, the Progressive Insured's vehicle sustained such property damage as to be considered totaled. 7. Pursuant to the terms and conditions of the insurance policy, Progressive incurred damages in the amount of $9,441.25 of which they were able to recoup $595.00 thereby incurring total damages in the amount of $8,846.25. A true and correct copy of Progressive's damage documentation is attached hereto as Exhibit "1". 8. Pursuant to the insurance policy issued by Progressive and as a result of said aforesaid payment, Progressive became subrogated to the claim of its Insured against Defendant. 9. Progressive Insured's also sustained damages in the amount of $500.00 representing her deductible. 10. Pursuant to Progressive's right of subrogation, Progressive IS presently due and owed from Defendant the sum of $9,346.25. WHEREFORE, Plaintiff demands Judgment against Defendant jointly and severally in the amount of $9,346.25 and costs.
