IN RE: EMERGENCY PETITION FOR APPOINTMENT OF GUARDIAN
ORDER OF COURT
AND NOW, this.'lJ"day of 2013, upon hearing Petitioner's
request for the appointment of emergency guardian for James Stover and receiving on the record
clear and convincing evidence that James Stover remains on life support with various other serious
medical complications, and therefore he lacks capacity to receive and evaluate information
effectively and to make and communicate decisions concerning management of his financial
affairs or to meet essential requirement for his physical health and safety, THE COURT FINDS
James Stover to be an incapacitated person.
IT IS ORDERED that Mary Stover,his wife of 29 years,is appointed emergency guardian
over the person of James Stover and over his estate for the maximum time permitted under 20 Pa.
C.S. § 5513 (23 days from the date of this Order for guardianship of the person; 33 days from the
date of this Order for guardianship of the estate). If Mr. Stover's condition does not improve in
that time,Petitioner shall file a petition seeking permanent guardianship. Her powers, duties, and
liabilities as emergency guardian shall be as provided in 20 Pa. C.S. § 5501 et seq. Mary
Stover, as guardian of James Stover, shall not be required to post a bond.
It is further ordered and directed that Mary Stover is authorized to pay from James Stover's
�+b'ank accounts reasonable attorneys' fees for this matter.
