STIPULATION AGAINST LIENS
WHEREAS, David J. Reeser and Bethann T. Reeser, husband and wife of
Pennsylvania, is about to execute contemporaneously herewith, a contract with EG Stoltzfus Homes,
LLC, a Pennsylvania Limited Liability Company of Lancaster County, Pennsylvania, for the erection
of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN Unit in the property known, named and identified in the
Declaration for Winding Hills, a Planned Community, dated July 26, 2005, recorded August 11;
2005, in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Miscellaneous
Book 719, Page 4220 ( "Original Declaration "), as amended and restated by Amended and Restated
Declaration for Winding Hills II, a Planned Community, dated August 9, 2012 ( "Amended and
Restated Declaration "), recorded August 10, 2012, in the Office of the Recorder of Deeds of
Cumberland County, Pennsylvania, as Instrument Number 201224290, as Winding Hills II, A
Planned Community (formerly known as Winding Hills, A Planned Community), located in Upper
Allen Township, Cumberland County, Pennsylvania, which has heretofore been submitted to the
provisions of the Pennsylvania Uniform Planned Community Act, 68 Pa. C.S.A. §§ 5101 et seq., as
amended, by the recording in the Office of the Recorder of Deeds of Cumberland County;
Pennsylvania, the Original Declaration and the Amended and Restated Declaration, and designated
in the Original Declaration as Unit No. 87 (Unit Identifying Number), as described in Exhibit C

Original Declaration, and shown and described, on Declaration Plats and Plans, dated July 11, 2005,
recorded August 11, 2005, in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania, in Right -of -Way Plan Book 13, Page 112.
CONTAINING 33,191 square feet, more or less, municipally numbered as 395 Lake
Drive, Mechanicsburg, Pennsylvania.
UNDER AND SUBJECT to restrictions and covenants of record, including, but not
limited to, Declaration of Covenants, Conditions and Easements for Winding Hills, A Planned
Residential Development, dated July 26, 2005, recorded July 29, 2005, in the Office of the Recorder
of Deeds of Cumberland County, Pennsylvania, in Miscellaneous Book 719, Page 2665, Declaration
of Master Association for Winding Hills, A Planned Residential Development, dated July 26, 2005,
recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in
Miscellaneous Book 719, Page 2677, Original Declaration (as described above), as amended, in part,
by the First Amendment to Declaration for Winding Hills, A Planned Community, dated October
30, 2007, recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania as
Instrument No. 200742252, which said Original Declaration and First Amendment to Declaration,
were amended and restated by Amended and Restated Declaration (as described above), Winding
Hills II Declaration Plans, dated July 17, 2012, recorded August 10, 2012, in the Office of the
Recorder. of Deeds of Cumberland County, Pennsylvania, as Instrument No. 201224290, and under
and subject to easements and rights -of -way of record.
BEING THE SAME PREMISES which Upper Allen Partners, L.P., a Pennsylvania
Limited Partnership, by deed dated October 9, 2012 and recorded on October 11, 2012 in the Office
of the Recorder of Deeds of Cumberland County, Pennsylvania in Instrument No.: 201231336,
granted and conveyed unto David J. Reeser and Bethann T. Reeser, husband and wife.
NOW, the t day of September, 2013, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said David
J. Reeser and Bethann T. Reeser, husband and wife to the said EG Stoltzfus Homes, LLC, a
Pennsylvania Limited Liability Company to commence work on the said building, or purchase
materials for the same in consideration of the making of the said contract with EG Stoltzfus Homes,
LLC, a Pennsylvania Limited Liability Company and the further consideration of One Dollar, to EG
Stoltzfus Homes, LLC, a Pennsylvania Limited Liability Company paid by David J. Reeser and
Bethann T. Reeser, husband and wife it is agreed that no lien shall be filed against the building by
the contractor, or any sub - contractor, nor by any of the material men or workmen or any other person
for any labor, or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.
