KELLY, of Camp Hill, Cumberland County, Pennsylvania, declare this to be my Last Will and Testament, and revoke any and all previous Wills and Codicils made by me. ITEM I: I direct that all my just debts and funeral expenses, including all expenses of my last illness, shall be paid from my residuary estate as soon as practicable after my death, as a part of the expense of the administration of my estate. ITEM II: All federal, state and other death taxes payable because of my death with respect to the property forming my gross estate for tax purposes, whether or not passing under this Will, including any interest or penalty imposed in connec- tion with such tax, shall be considered a part of the expense of the administration of my estate and shall be paid out of the residue of my estate, without apportionment or right of reim- bursement. ITEM III: I give, devise and bequeath all the rest, residue and remainder of my estate of every nature and wheresoever situate to be divided equally among my three children, KATHLEEN M. CLEVELAND of Harrisburg, Pennsylvania, JEANNE R. KELLY of Camp Hill, Pennsylvania and PATRICK M. KELLY of Lititz, Pennsylvania. In the event any of my children should predecease me, then his or her share shall be divided equally between my remaining living children. ITEM IV: My daughter, JEANNE R. KELLY is unable to live independently and requires assistance with her daily living and personal needs, as well as financial guidance. Therefore, I nominate my daughter, KATHLEEN M. CLEVELAND to serve as my daughter, Jeanne R. Kelly's Guardian of the Person. ITEM V: With regard to my daughter, JEANNE R. KELLY's portion of my Estate which is to be distributed in Item III, her share should be held IN TRUST and be used for her support and daily living expenses as deemed in the discretion of her Trustee and Guardian of the Person.
