The plaintiff is Jeffrey Robert Pottinger, an adult individual, who currently resides
at 67 Regency South, Carlisle, Cumberland County, Pennsylvania, 17013.
The defendant is Sherry Marie Pottinger, an adult individual whose last known
address was 2414 Sawyer Lane, Aransas Pass, Texas, 78336.
Plaintiff has been a bona fide resident of the Commonwealth for at least six (6)
months immediately preceding the filing of this Complaint.
Plaintiff and Defendant were married on February 29, 2000, in Corpus Christi,
Aransas County, Texas.
The parties to this action have lived separate and apart since October 4, 2004.
Both parties are citizens of the United States of America.
Neither party is a member of the Armed Services of the United States of America or
its Allies.
8. Plaintiff avers that the Defendant has offered such indignities to the Plaintiff so as to
render his condition intolerable and life burdensome.
9. The Plaintiff has been advised of the availability of counseling and that the Plaintiff
may have the right to request that the Court require the parties to participate in
counseling. The Plaintiff has declined counseling.
10. The marriage is irretrievably broken.
11. Plaintiff requests the Court to enter a Decree in Divorce pursuant to 3301 (a).
12. This action is not collusive.
COUNT II
CLAIM FOR EQUITABLE DISTRIBUTION OF MARITAL PROPERTY
UNDER SECTION 3502 OF THE DIVORCE CODE
13. Paragraphs one (1) through twelve (12) are incorporated herein by reference.
14. Plaintiff and Defendant have acquired various assets and liabilities during their
marriage.
15. All property acquired during the marriage is subject to equitable distribution by this
Court as "marital property".
16. Plaintiff requests that all marital property be equitably divided.
WHEREFORE, the Plaintiff requests the Court to enter a Decree in divorce dissolving the
marriage between the Plaintiff and Defendant, and equitably distributing all marital property owned
by the parties hereto.

EXPERT WITNESSES
Plaintiff knows of no expert witnesses at this time. However, Plaintiff reserves the

NON-EXPERT WITNESSES
Plaintiff submits the following factually witnesses will be called to testify at trial:
a. Plaintiff: He will testify as to the marital assets and liabilities that
existed at the time of separation.
b. Defendant: (as on cross)
C. Maureen Pottinger: 282 Ridge Hill Road, Mechanicsburg, PA
17050. She will testify that she loaned the parties' $25,000.00 so
that they could purchase the marital residence. The parties agreed to
pay here in monthly installments until the debt was paid in full.
d. Lyndee Blymier: 130 Rex Drive, Carlisle, PA 17015. She will
testify that she was aware of the parties' agreement with Maureen
Pottinger that the money was loaned to the parties to purchased the
home.
e. Holly Pottinger: 7554 Cloverlee Blvd., Harrisburg, PA 17112. Will
testify that the parties borrowed money from Maureen Pottinger to
purchased the marital residence, and that the parties agreed to repay
Ms. Pottinger in full in monthly installments.
Plaintiff reserves the right to supplement this list with additional witnesses,
should it be necessary.

7. PENSIONS/RETIREMENT
A. Plaintiff - Plaintiff had a 401(K) with his employer, Walmart. The entire plan is
marital property, and at the time of separation, the retirement plan was valued at
$394.53. See Exhibit "G".
B. Defendant - Defendant had a retirement plan with her employer, which at the time
of separation was valued at $1,565.46. Her entire retirement plan is marital
property. See Exhibit "H".
8. COUNSEL FEES
Neither party has made a claim for counsel fees, and Plaintiff submits that each party shall
be responsible for their own attorney's fees.
9. PERSONAL PROPERTY DISPUTE
The parties have divided the personal property to their mutual satisfaction.
10. MARITAL DEBTS
a. 1994 Chevy 5-10 Blazer (Husband's vehicle) $4,641.20 owed on car loan. It was
purchased prior to separation. Husband paid approximately seven months of debt
before trading the vehicle in. The balance of the debt was included in the new car
loan so that the payments were manageable.
b. 2000 Dodge Caravan (Wife's vehicle) $10,688.22 owed on car loan. Car
was purchased prior to separation. Husband paid approximately seven months of
payments post-separation. In March, 2005, Plaintiff traded in this vehicle and the
balance of the debt was included in the new car loan to make the payments
manageable.
C. Maureen Pottinger: In August, 2004, the parties borrowed $25,000.00 from
Maureen Pottinger to purchase the marital residence. Plaintiff has been unable to
make any'payments on said debt to date, as his limited income precludes him from
paying this and the other marital debts. In addition to witness testimony, Maureen
Pottinger has documentation to support the fact that she refinanced her home to loan
the parties the money. Said documents have already been supplied to counsel.
d. Personal Service Loan $2,020.14. The loan was used in part to pay off Wife's
dental bills. The date this debt was initially incurred is not known, although it is
prior to separation. Plaintiff has assumed responsibility in paying this debt.
e. Navy Federal Credit Union credit card $591.43, used to purchase various marital
property. Plaintiff has assumed responsibility in paying this debt. The date this debt
was incurred is not known, although it is prior to separation.
11. PROPOSED RESOLUTION
Plaintiff proposes that a decree in divorce be entered pursuant to §3301 (c) of the Divorce
Code, and that the assets and liabilities distributed 50%-50%.

to request entry of the Decree.

1. I consent to the entry of a final Decree of Divorce without notice.
2. I understand that I may lose rights concerning alimony, division of property,
lawyer's fees or expenses if I do not claim them before a divorce is granted.
3. I understand that. I will not be divorced until a Divorce Decree is entered by the
Court and that a copy of the Decree will be sent to me immediately after it is filed with the
Prothonotary.
