TIMOTHY A. COLE and STACEY M. COLE, OWNER, adult individuals with a residence
address of 313 Raymon Avenue, Boiling Springs, Pennsylvania, hereinafter called "Owner", have
entered into a contract with RALPH J. IACONO, an adult individual with a principal place of business at
41 Kensington Square, Mechanicsburg, Pennsylvania, hereinafter called "Contractor", for the erection
of a single family residential dwelling upon land of Owner situate in Middlesex Township, Cumberland
County, Pennsylvania, being more particularly bounded and described on Exhibit "A," attached hereto
and made part hereof.
NOW, this 9th day of December, 2004, before any authority has been given by the said Owner to
the said Contractor to commence work on the said improvements or purchase materials for the same, in
consideration of the making of the said contract with Owner and the further consideration of One Dollar
($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against said property by the
Contractor, or any sub-contractor, nor by any of the material-men or workmen or any other person for
any labor, or materials purchased, or extra labor or materials purchased for the installation and
construction of said municipal improvements, the dght to file such liens being expressly waived.
THIS Stipulation Against Liens has been executed by Owner and Contractor on the day above
written.

LEGAL DESCRIPTION
ALL THAT CERTAIN tract of land situate in Middlesex Township, Cumberland County,
Pennsylvania, being Lot No. 68, as shown on the Plan entitled Meadowbrook Farms
Final Subdivision Plan Phase III dated October 17, 2000, revised August 12, 2003, and
recorded August 21,2003, in Cumberland County Plan Book 87, Page 99, more
particularly bounded and described as follows:
BEGINNING at an iron pin, being a westedy corner of Lot No. 69 and lying in a northerly
R/VV line of Bayberry Road (50' R/VV); thence along said RAN, along a curve to the left,
having a chord bearing of North 57 degrees 56 minutes 23 seconds west, a chord
distance of 105.83 feet, a radius of 225.00 feet and an arc length of 106.83 feet to an
iron pin, lying in a northerly line of said ~ and being a southerly corner of Lot No. 67;
thence along said lot, North 18 degrees 27 minutes 29 seconds east, 181.03 feet to an
iron pin, being an easterly corner of said lot and lying in a southerly line of existing
Phase 2; thence along said lands, South 51 degrees 38 minutes 54 seconds east,
187.15 feet to an iron pin, lying in a southerly line of said lands and being a northerly
corner of Lot No. 69; thence along said lot, South 45 degrees 39 minutes 46 seconds
west, 159.93 feet to an iron pin, being the place of BEGINNING.
BEING THE SAME PREMISES which Worthington Development, L.P., a Pennsylvania
limited partnership, by its deed dated December 6, 2004, to be recorded in the Office of the
Recorder of Deeds for Cumberland County, Pennsylvania, granted and conveyed unto
