PETITION FOR REMOVAL OF TRUSTEES
IN ACCORDANCE WITH 20 Pa.C.S. § 7766(b) AND ACCOUNTING
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
The petition of Glen H. Stoner respectfully states that:
1. Glen H. Stoner ("Settlor") created the Glen H. Stoner Irrevocable Trust Dated
March 30, 2004. A copy of the trust is attached as Exhibit"A."
2. On August 30, 2006, Kenneth E. Stoner, Sr., acting as Trustee, amended paragraph
THIRD of the Glen H. Stoner Irrevocable Trust Dated March 30, 2004, removing Beverly J.
Carlson as successor Trustee and replacing her with Rosey Stoner and adding Wayne Stoner and
Ronnie Stoner as additional successor co-trustees. A copy of the amendment is attached as
Exhibit"B."
3. Both Kenneth E. Stoner and Rosey Stoner have passed, thereby making Wayne
Stoner and Ronnie Stoner the current co-trustees of the trust. Wayne Stoner resides at 506 Dave
Drive, Mechanicsburg, PA 17055. Ronnie Stoner is believed to reside at 24 Bedros Street,
Winham, NH 03087.
4. Beneficiaries under the trust are Bonnie Hockley, 25 Annendale Drive, Carlisle, PA
17015-9140 and Kenneth E. Stoner Jr., 1 Sunset Circle, Mechanicsburg, PA 17050-2456.
5. The trust is believed to be valued at approximately $714,000, composed primarily
of proceeds remaining from the sale of real property in Illinois.
6. The exact contents of the trust are unknown; however, Ronnie Stoner and Wayne
Stoner filed a Petition for Adjudication of Incapacity and Appointment of Guardian in October of
2011 and in that petition they averred Glen Stoner's then-current assets were:

Irrevocable Trust $710,000
Cash assets $92,000
2008 Mercury Sable $22,000
Miscellaneous personal property $12,000
7. After a hearing on Ronnie Stoner and Wayne Stoner's petition, this Honorable
Court issued an Order dated December 30, 2011, denying their request to be appointed plenary
guardians of Glen H. Stoner's estate and instead appointing Orrstown Bank as plenary guardian.
8. However, Wayne and Ronnie continued to act as co-trustees of the Glen H. Stoner
Irrevocable Trust.
9. Both Wayne and Ronnie have been unable and incompetent to attend to the duties
of the office, and have substantially impaired the trust administration.
10. Both Trustees have also breached their fiduciary duty to the trust and to the settlor
who is the beneficiary of the trust.
11. The co-trustees have mismanaged and wasted the estate in the following ways:
a. Removing $25,000 from the trust for the purpose of"loan to Kenneth Stoner."
b. Removing $7,642.10 from the trust for the purpose of"reimburse Ronnie."
c. Using their power of attorney (since revoked), Wayne Stoner and Ronnie Stoner
removed $10,496.79 from settlor's account at M&T Bank without his consent or
knowledge, and made a check payable to the Glen H. Stoner Irrevocable Trust
Dated March 30, 2004;
d. Invaded his checking account and deposited other proceeds into the Trust
Account.
e. Wrote a check retaining Seratelli, Shiffman & Brown, P.C., a Harrisburg law
firm specializing in disability law, for $2,500 when Glen Stoner has been
receiving Social Security payments for many years and would have no need of a
disability attorney.
12. It is likely that the co-trustee's mismanagement and persistent failures will continue
and result in further loss to the trust.
13. Trustees have also failed to make income payments to Settlor and failed to
acknowledge requests for distributions to assist him with his support, maintenance and welfare.
14. In addition, Trustees have fraudulently reimbursed themselves under the claim of
"cash" for settler or direct reimbursements for money they purportedly gave to settlor.
15. Petitioner is Glen Stoner and is the only party who has a present interest in the trust.
16. Parties with future interests in the trust would be "the living nieces and nephews of
Glen H. Stoner, namely, Wayne P. Stoner, Ronnie E. Stoner, Kenneth E. Stoner, Jr., and Bonnie
Hockley."
17. However, Glen H. Stoner's niece Connie M. Stoner does not have a future interest
as she was intentionally omitted as a beneficiary of the trust by a purported amendment.
18. Trustees are further violating their fiduciary duty by failing to fulfill the very
essence of the Trust to provide for settlers support health, welfare and maintenance.
19. To the contrary, Trustees are merely preserving capital and income for their own
gain.
20. Removal of the trustee is appropriate and warranted under the provisions of 20
Pa.C.S.§ 7766(b).
21. Petition prays his daughter, Janet Swope shall be appointed Trustee so that his
needs can be rightfully paid for and his care adequately compensated.
WHEREFORE, petitioner respectfully requests that this Court:
(a) order a complete accounting;
(b) direct certain funds be paid back which were unlawfully added to the trust;
(c) award a citation, directed to Wayne Stoner and Ronnie Stoner to show cause why
each should not be removed as trustee of the trust under Paragraph THIRD of the
trust dated March 30, 2004 as amended on August 30, 2006;
(d) Janet Swope should be named Trustee; and
(e) Reimburse Petitioner counsel fees in this matter.
