JOHNS of 42 Sherwood Circle, Enola, Pennsylvania, is about to execute contemporaneously herewith, a contract, with CARLSON CONSTRUCTION, INC. of 1085 Country Club Road, Camp Hill, Pennsylvania, for the erection of a building upon premises commonly known as LOT H-13 FASHION CIRCLE, Township EAST PENNSBORO, CUMBERLAND County, Pennsylvania, as set forth in the deed dated , recorded at Deed Book __, Page __, in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, February 20, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Carls~, President OWNER:// j~JOH'N~~j''''~ JILLA~JOH~ 0 '- Exhibit "A" ALI, THAT CERTAIN piece or parcel of land situate in East Permsboro Township, Cmmberland County, pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the westem side of Fashion Circle at the n°rtheastem comer of Lot No. H-14 on the hereinafter mentioned Plan of Lots; thence along the western side of Lot No. H-14, South 28 degrees 38 minutes 23 seconds West, a distance of 125.00 feet to a point at the eastern line of lands now or formerly of Floribunda Associates, L.P.; thence along the said eastern line of said lands, North 51 degrees 07 minutes 60 seconds We~t, a distance of 100.00 feet to a point at the same said lands of Floribunda Associates, L.P.; thence along those said same lands, North 15 degrees 43 minutes 46 seconds West, a distance of 103.50 feet to a point at the southwestern comer of Lot No. H-12 on the hereinafter mentioned Plan of Lots; thence along the southem side of Lot No. H-12, South 87 degrees 20 minutes 58 seconds East, a distance of 140.00 feet to a point on the western side of Fashion Circle; thence along the said westem line of Fashion Circle, by a curve to the right having a radius of 50.00 feet and an arc length of 55.86 feet to a point, the point and place of BEGINNING. BEING LOt No. H-13, on the Final Subdivision Plan of Floribunda Heights, Phase II, Sections K & H, dated October 5, 1999, prepared by Melham Associates, P.C., and recorded in the Office of the Recorder of Deeds, Cmnberland County,. Pennsylvania, in Plan Book 80, Page 45 and revised on February 17, 2000 and re-recorded in Plan Book 80, Page 104.
