Olsen, Esquire, and files the within Petition for Order Directing Residuary Distribution from the Estate of Jean L.Zeigler for the Benefit of a Minor and to Appoint Petitioner as Guardian of the Estate of the Minor as to the Residuary Distributive Share, and in support thereof, avers as follows: I. HANNAH ZEIGLER,the minor,currently resides with her mother,Sarah Zeigler,at 15579 Catamaran Court, Dumfries, VA 22025-124$, 2. As of the date of the filing of this Petition,I IANNAII ZEIGLER is fifteen(15)years of age, her date of birth being December 31, 1997. c 3. HANNAH ZEIGLER has never been married. •-" p rs rri 4. HANNAH ZEIGLER is not a patient in a mental hospital. 2 r u; ca 5. The Petitioner is HANNAH ZEIGLER's uncle. 6. Petitioner,MICHAEL L.ZEIGLER,resides at 312 N. 2"d Street,Wormleysburg,PA 17043; he is 64 years of age, his date of birth being March 6, 1949, 7, HANNAH ZEIGLER's grandmother, JEAN L. ZEIGLER, died on May 4, 2012, leaving a Last Will and Testament dated August 3,2009(the"Will"). A copy o'fthe Will is attached hereto as Exhibit"A." 8. The aforesaid Will named MICHAEL L.ZEIGLER as Executor. 9. Letters Testamentary on the Estate of Jean L. Zeigler were issued by the Register of Wills of Cumberland County Pennsylvania and were granted to MICHAEL L.ZEIGLER,Petitioner herein,,on June 6, 2012. 10. Article V of the Will of Jean L. Zeigler devised and bequeathed the residue of her estate to her sons, Michael L. Zeigler and Randy E. Zeigler,per stirpes. 11. Randy E. Zeigler predeceased Jean L. Zeigler in 2011. 12. HANNAH ZEIGLER is the daughter of Randy E. Zeigler, and she is entitled to receive her deceased father's share of the Estate of Jean L. Zeigler. 13. HANNAH ZEIGLER's residual share of the Estate of Jean L. Zeigler is approximately Forty Thousand($40,000.00)Dollars. A statement of the account is attached hereto as Exhibit `B." 14. HANNAH ZEIGLER cannot legally receive her inheritance until she is eighteen(18) years of age. 15. The names and addresses of those person(s)who would be the intestate heirs(or next of kin)of HANNAH ZEIGLER are as follows: Sarah Zeigler(mother),of 15579 Catamaran Court, Dumfries, VA 22025-1248. 16. Sarah Zeigler,mother of HANNAH ZEIGLER,joins in this Petition, Her Joinder is attached hereto as Exhibit "C." WHEREFORE,Petitioner respectfully requests that this Court enter an order pursuant to 20 Pa.C.S.A. §5101 appointing MICHAEL L. ZEIGLER as Guardian of the Estate of the Residual Distributive Share of HANNA ZEIGLER and directing that MICHAEL L. ZEIGLER,Executor of the Estate of Jean L. Zeigler, shall distribute to Petitioner, the total residual share due HANNAH ZEIGLER,to be held by MICHAEL L. ZEIGLER and used for the benefit of HANNAH ZEIGLER until she reaches eighteen years of age, at which time any remaining principal and accumulated income shall be distributed to HANNAH ZEIGLER outright. Zeigle LAST WILL AND TESTAMENT OF JEANL. ,ZEIGLER I, JEAN L. ZEI+GLER, now domiciled in Cumberland County, Pennsylvania, declare this to be my Last Will and Testament. I revoke all other wills and codicils that I may have previously made. Article I My just debts and expenses of my last illness, funeral, and administration of my estate shall be paid by my Executor from the principal of my residuary estate as soon as practicable after my death. Article II All inheritance, estate, and succession taxes (including interest and penalties thereon, but not including any generation skipping tax) payable by reason of my death shall be paid out of and be charged generally against the principal of my residuary estate without reimbursement from any person. This provision is not a waiver of any right which my Executor has to claim reimbursement for any such taxes which become payable as the result of any property over which I have the power of appointment. Article III I give, devise and bequeath my tangible personal property in accordance with any memorandum I have handwritten or signed, located with my will or with my valuable papers and found within 30 days of the probate of my will. Gifts may only be to persons who survive me or to organizations which exist at my death, and if there is a conflict, the memorandum having the latest date shall govern. To the extent no such memorandum is found, or all of my tangible personal property is not disposed of pursuant thereto, my tangible personal property shall be added to my residuary estate and pass under Articles IV and V hereof. Article IV If my spouse, EDWARD L. ZEIGLER, survives me by one hundred seventy (170) days, I give, devise and bequeath to my spouse cash, securities or other property of my estate having a value equal to the amount, if any, that my spouse would be entitled to receive if he exercised his elective share rights as set forth in section 2201 et seq. of the Pennsylvania Probate, Estates and Fiduciaries Code (the "PEF Code"); provided, however, that this bequest shall be reduced to the extent my spouse has waived the right to elect under PEF Code section 2207 or forfeited the right to elect under PEF Code section 2208_ In computing the amount of this bequest, it shall be assumed that my spouse has elected under PEF Code section 2204(c) to retain all beneficial interests in property that he would otherwise be required to disclaim if he exercised his elective share rights. Provided my spouse survives me for one hundred seventy (170) days and he has not waived or forfeited his elective share rights, it is my intention, that as a result of my death, he receive property having a value equal to (but not more than) that which he would receive if he were to exercise his elective share rights. My Executor shall have the sole discretion to select the assets which shall constitute this bequest. If my spouse does not survive me by one hundred seventy (170) days, or in the event my spouse (or his legal representative) disclaims any portion of this bequest, this bequest, or the disclaimed portion thereof, shall be distributed as part of my residuary estate. This bequest shall be distributed, in trust, to my hereinafter-named Trustee to be held, administered and distributed as follows: 2 ilmmm A. To expend and apply so much of the net income and so much of the principal of the Trust as the Trustee shall consider advisable for the support, health, and care of EDWARD L. ZEIGLER, for the remainder of his lifetime. B. In the event of EDWARD L. ZEIGLER's death, the trust shall terminate, and the remaining principal and accumulated income of the trust shall be distributed in equal shares outright to my children, MICHAEL L. ZEIGLER and RANDY E. ZEIGLER,per stirpes. C. No beneficiary or remainderman of this Trust shall have any right to alienate, encumber, or hypothecate his interest in the principal or income of the Trust in any manner, nor shall any interest be subject to claims of his creditors or liable to attachment, execution, or other processes of law, D. I hereby appoint my son, MICHAEL L. ZEIGLER, as Trustee of any Trust(s) created in this Will for the benefit of my spouse. In the event of the renunciation, death, or inability to act, for any reason whatsoever of MICHAEL L. ZEIGLER I nominate, constitute and appoint my son, RANDY E. ZEIGLER, successor Trustee, of any Trust(s) created in this Will for the benefit of my spouse. E. In order to carry out the purposes of the Trust established by this Will for the benefit of EDWARD L. ZEIGLER, the Trustee, in addition to all other powers granted by this Will or by law, shall have the following powers over the Trust estate, subject to any limitations specified elsewhere in this Will: (a) to retain in the form received and/or to sell either at public or private sale, any real estate or personal property except that which I specifically bequeath herein; (b) to manage real estate; (c) to invest and reinvest in all forms of property without being confined to legal investments, and without regard to the principal of diversification; 3 Sm (d) to exercise any option or right arising from the ownership of investments; (c) to compromise claims without court approval and without consent of any beneficiary; (f) to file fiduciary/income tax returns and pay the tax due for any year for which such a return is required; (g) to make distributions in cash or in kind, or in both, and to determine the value of any such property; (h) to employ any attorney, investment advisor, or other agent deemed necessary by my Executor; to pay from my estate reasonable compensation for all their services; (i) to conduct alone or with others, any business in which I am engaged in or have an interest in at the time of my death; and (j) to receive reasonable compensation in accordance with their standard schedule of fees in effect while their services are performed. Article V All the rest, residue and remainder of my estate, of whatsoever nature and wheresoever situate, I give, devise and bequeath to be equally divided between my children, MICHAEL L. ZEIGLER, of Wormleysburg, Pennsylvania, and RANDY E. ZEIGLER, of Dumfries, Virginia,per stirpes. If either of my children fails to survive me by thirty (30) days, but leaves descendants who survive me by thirty(30) days, those descendants shall receive,per stirpes, the share the child would have received had he or she survived me by thirty(30) days. The share of any deceased child who does not have living issue shall be divided and distributed to my remaining child,per stirpes. 4 Article VI It is my intent that all life insurance, annuities, individual retirement accounts and any other assets in which I may designate a beneficiary will pass to the beneficiary that I have named and will not be controlled by the provisions of this Will. It is also my intent that any assets I own jointly with another with rights of survivorship or a presumed right to survivorship which such joint ownership was created before or after this Will, will pass to the surviving joint owner and will not be controlled by the provisions of this Will. Article VII I nominate, constitute and appoint my son, MICHAEL L. ZEIGLER, as Executor of my Last Will and Testament. In the event of the renunciation, death, or inability to act, for any reason whatsoever of my Executor, I nominate, constitute and appoint my son, RANDY E. ZEIGLER, successor Executor of my Last Will and Testament. I direct that my Executor or successor Executor be permitted to serve without bond. In addition to those powers granted by law, I grant them power to distribute in cash or in kind, in like or in unlike shares, and to file any qualified disclaimer I could have filed if living. My Executor or successor Executor shall receive reasonable compensation for services rendered to my estate.
