Radebach, hereby appeal to this Honorable Court pursuant to 72 P.S. §5020-518.1 for review of a decision of the Cumberland County Board of Assessment Appeals in its denial of Appellants' request to reverse roll back taxes For Cumberland County 38-05-0435-021, and in support thereof avers the following: 1. Nicholas Halkias and Carolyn H. Halkias, Trustees of the Nicholas Halkias Living Trust and Carolyn H. Halkias and Nicholas Halkias, Trustees of the Carolyn H. Halkias Living Trust, both dated March 5, 2001, are adult individuals residing at 1330 Quail Hollow Road, Harrisburg, Pennsylvania, 17112 2. Appellants awn real property identified as 7108 Wertzville Road, Silver Spring Township, Cumberland County, Pennsylvania, by virtue of a deed dated October 1, 2009, and recorded October 2, 2009, in the Office of the Recorder of Deeds of Cumberland County Pennsylvania at Instrument No.200933942, which premises were described therein as follows ALL THAT certain farm composed of a tract of land and the improvements thereon erected situate in Silver Spring Township, Cumberland County, Pennsylvania, being described as follows, to wit: BEGINNING at a point in or near the centerline of State Route 0944, more commonly known as the Wertzville Road, having a forty(40)ft.wide right of way, said point being located thirty and nine one- hundredths(30.09)feet from a set steel rebar on the western boundary line of lands of Edward M. Jones. South 64 degrees 26 minutes 02 seconds West, passing through and across Township Road 592, more commonly known as Linda Drive, having thirty-three(33)feel wide legal right-of-way and in and along a private lane known as Vogelsong Lane, a distance of one thousand four hundred seventy-five and five one-hundredths (1,475.05)feet to a set steel rebar on the eastern boundary line of lands now or formerly of Loretta J. Danner; thence along the said line of lands now or formerly of said Danner and continuing along the eastern boundary line of lands now or formerly of William L. Danner. Jr. and further continuing along the eastern boundary line of lands now or formerly of Helen M. Vogelsong, passing through or near to a twelve(12) inch cherry tree, passing through and across said State Route 0944, and passing through or near to a twelve(12) inch locust tree. North 01 degree 13 minutes 23 seconds East, a distance of two thousand twenty-five and fourteen one-hundredths(2,025.14)feet to a corner fence post found on the southern boundary line of lands now or formerly of Calvin D. McCarthy and Arlene M. McCarthy: thence along said line of lands of said McCarthys, passing through or near a twenty-two(22) inch oak tree and an eight(8)inch cherry tree, North 86 degrees 56 minutes 25 seconds East, a distance of two thousand three hundred thirty-six and ninety-three one-hundredths(2,336.93)feet to a steel rebar found on the western boundary line of lands now or formerly of Edward M.Jones, Jr.; thence along said line of lands now or formerly of said Jones, through a steel rebar found on said line, through a wooded area, and through a steel rebar set on said line slightly North of the northerly legal right- of-way line of said State Route 0944, South 01 degree 56 minutes 00 seconds East, a distance of eight hundred fifty-one and seventy-four one-hundredths (851.74)feet to a point in or near the centerline of said State Route 0944, more commonly called the Wertzville Road, aforesaid, said point being located thirty and nine one-hundredths(30.09)feet from the last said set steel rebar, said point being the aforesaid point and place of BEGINNING. The subject premises were enrolled in the preferential real estate tax assessment program by virtue of an Application recorded in the Office of the recorder of Deeds of Cumberland County, Pennsylvania at Record Book 236, Page 1, as modified by revision recorded in the office of the Recorder of Deeds Office of Cumberland County, Pennsylvania at Miscellaneous Book 717, Page 4578, which enrollment was amended and continued by Appellants with a filing dated October 24, 2009 and recorded November 4, 2009, in the Office of Recorder of Deeds of Cumberland County at Instrument No. 200937349. See Exhibit B, attached hereto, which is hereby made a part hereof. 4. Appellants obtained a subdivision of the premises described in Paragraph 2 above for separation and conveyance of a portion thereof to Holy Apostles Orthodox Mission, which was identified as Lot No. 2 on a Subdivision Plan dated February 19, 2013, and recorded on March 12, 2013, in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania at Instrument No. 201308048, containing 13.706 acres. See Exhibit C, attached hereto, which is hereby made a part hereof. 5. By deed dated March 15, 2013 and recorded April 8, 2013, in the Office of Recorder of Deeds of Cumberland County, Pennsylvania at Instrument No. 201311078, Appellants transferred fee title unto Holy Apostles Orthodox Mission, for the premises which are described as follows: ALL that certain piece, parcel or tract of land, together with the improvements erected, situate in Silver Spring Township, Cumberland County, Pennsylvania, identified as Lot No. 2 on a Subdivision Plan dated February 19, 2013, and recorded on March x, 2013, in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania at Instrument No. 201308048,which premises are bounded and described as follows, to wit BEGINNING at a Concrete Monument on the south dedicated right of way line of Wertzville Road (S.R. 0944), at line of lands now or formerly of Lester L. Vogelsong and Helen M. Vogelsong; thence along the southern right of way line of Wertzville Road, North eighty-eight degrees (88°)twelve minutes (12')twenty seconds(20") East, the distance of five hundred twenty-five and forty-five hundredths feet(525.45')to a concrete monument set at the western right of way line of Linda Drive(T-592); thence along same, along the arc of a fifty-five and zero hundredths feet(55.00')radius curve to the left, which curve is subtended by a chord lying to the north-east thereof, which chord has a bearing South fifty- one degrees(51°)fifty-eight minutes(58')thirty-three seconds(33") East and a chord distance of seventy and forty-four hundredths feet(70.44'), an arc distance of seventy-six and forty-five hundredths(76.45')to an iron pin set; thence continuing along Linda Drive, South twelve degrees(12°)nine minutes (09')twenty-six seconds (26")West, the distance of six hundred eighty-seven and sixty-seven hundredths feet(687.57')to an iron pin set at line of lands now or formerly of Larry L. Appellants aver that the aforesaid transfer constituted a separation of the premises described in Paragraph 2 for purposes of the Clean and Green Tax Assessment law, because the acreage exceeded ten (10) acres and the use remained agricultural. 7. Appellants are informed and believe and therefore aver that the aforesaid Lot No. 2 will be developed for religious purposes by Holy Apostles Orthodox Mission, by construction of a church building to conduct regularly held religious activities. 8. On April 26, 2013, Appellants filed an Amendment to Approved Clean and Green Application for the subject premises setting forth a change in acreage due to the subdivision and separation of Lot No. 2, aforesaid which application was recorded May 16, 2013 in the in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania at Instrument No. 201316142. See Exhibit E, attached hereto, which is hereby made a part hereof. 9. Appellants aver that the Cumberland County Tax Assessment Office treated the transfer described in Paragraph 5 above as a split-off under the provisions of the Pennsylvania Farmland and Forest Land Assessment Act of 1974, Act of December 19, 1974, P.L. 973, No. 319, as amended, and imposed a roll back tax upon the Appellants. 10. Appellants aver that the subject transfer was a Separation as defined under the Clean and Green Law and regulations promulgated thereunder at 7 Pa. Code 137b.2, and where there is no change in use there should be no roll-back tax assessed. 11. Appellants made a timely appeal to the Cumberland County Board of Assessment Appeals, which conducted a hearing and rendered a decision on September 10, 2013, confirming the roll-back tax assessment. See Exhibit F, attached hereto, which is hereby made a part hereof. 12. Appellants aver that such a determination was unwarranted, unjustified, arbitrary and capricious and constitutes substantial harm to Appellants. WHEREFORE, appellant respectfully requests that this Honorable Court for a Hearing de novo pursuant to 72 P.s. §5020-518.1 and that the roll-back tax assessment by the Cumberland County Board of Assessment Appeals be set aside.
