APPEAL FROM THE CUMBERLAND COUNTY BOARD OF ASSESSMENT APPEALS
1. The Appellant is WRD Shippensburg LP, c/o WRDC, 123 Coulter Avenue,
Suite 200, Ardmore, PA 19003. This Appeal is filed by its attorney Zimmerman,
Pfannebecker, Nuffort & Albert, LLP. The Appellant is the owner of the property subject to
this Appeal.
2. WRD Shippensburg LP had filed an Appeal with the Cumberland County
Board of Assessment Appeals appealing the assessment originally fixed by the Board
which was:
Tax Parcel No. 36-33-1871-016:
Total: $2,450,000.00
Tax Parcel No. 36-33-1871-016A:
Total: $2,145,000.00
3. With the consent of the appellant property owner, the Board deleted Parcel
36-33-1871-016A and no appeal is taken from the decision of the Board with reference to
that one tax parcel. This appeal is limited to the one remaining tax parcel that constitutes

the Shippensburg Shopping Center, specifically Parcel 36-33-1871-016.
4. On September 27, 2013, the Cumberland County Board of Assessment
Appeals rendered its final Decision as follows,
Tax Parcel No. 36-33-1871-016:
Total: $4.595,200.00
Tax Parcel No. 36-33-1871-016A:
Total: $ 0.00
True and correct copies of the said Notices are attached hereto, fully incorporated herein
by reference and marked for identification as Exhibit "A".
5. This Appeal is filed by the Appellant as owner of the property to contest the
assessment applied to the above tax parcel by the Board of Assessment Appeals.
6. This Appeal is filed for one or more of the following reasons:
A. The assessment of Appellant's property is not uniform with other
assessments in Cumberland County.
B. The assessment is arbitrary, excessive and unreasonable.
C. The assessment does not conform with the common level ratio that exists
in Cumberland County so that Appellant's property is assessed at a
higher rate than other real property owners.
D. The assessment of Appellant's property does not accurately reflect its
present fair market value.
E. The assessment of Appellant's property is otherwise illegal,
unconstitutional, non-uniform, arbitrary and unreasonable.

MOTION FOR CONTINUANCE
AND NOW, comes the Respondent, Cumberland County Board of Assessment
Appeals, and files this Motion for Continuance of which the following is a statement:
1. Movant is the Cumberland County Board of Assessment Appeals,
Respondent in the above-captioned matter.
2. On October 11, 2013, Petitioner, WRD Shippensburg, LP, filed a Petition
for Allowance of Appeal from a Decision of the Cumberland County Board of
Assessment Appeals.

3. On November 7, 2013, the Court, by the Honorable Thomas A. Placey,
entered an Order scheduling a hearing for Wednesday, February 26, 2014.
4. Movant, Cumberland County Board of Assessment Appeals, desires to
coordinate with the taxing bodies for the retention of an expert appraiser to provide an
appraisal report and expert testimony for the hearing, but is unable to have this
accomplished by the hearing date of February 26, 2014.
5. Movant, Cumberland County Board of Assessment Appeals, requested
that the Petitioner, WRD Shippensburg, LP, concur in this request for a continuance,
and Petitioner has elected to concur in that request.
7. The parties are significantly far apart in their valuation of the property. In
addition to assisting the Movant and the taxing bodies in preparing for trial, the
preparation of an appraisal by an outside expert may assist the parties in settlement
negotiations.
8. In order to properly prepare an appraisal for the hearing, and in order to
allow the new solicitor for the Board to properly prepare for and attend the hearing, it is
respectfully requested that this Court grant a general continuance to allow the parties to
develop their evidence for the hearing, and attempt to settle the case.

WHEREFORE, Movant, Cumberland County Board of Assessment Appeals,
prays Your Honorable Court for an Order cancelling the hearing presently scheduled for
February 26, 2014, and grant a general continuance in the above captioned case.
