CORPORATION, HOME EQUITY MORTGAGE ASSET - BACKED PASS - THROUGH
CERTIFICATES, SERIES 2002 -KSI, 3451 Hammond Avenue, Waterloo, IA 50702.
2. The name(s) and address(es) of the Defendant(s) is /are GREGORY CASNER, Solely in His Capacity as
Heir of HENRY B. CASNER, Deceased, 516 Hamilton Street, Harrisburg, PA 17102, HENRY
BROWNAWELL, Solely in His Capacity as Heir of HENRY B. CASNER, Deceased, 1901 Douglas
Drive, Carlisle, PA 17013, MELVIN BROWNAWELL, Solely in His Capacity as Heir of HENRY B.
CASNER, Deceased, 102 Parsonage Street, Newille, PA 17241, RICHARD BROWNAWELL, Solely in
His Capacity as Heir of HENRY B. CASNER, Deceased, 10 Hill Drive, Newville, PA 17241, SUSAN
DARR, Solely in Her Capacity as Heir of HENRY B. CASNER, Deceased, 436 Factory Street, Carlisle,
PA 17013 and UNKNOWN HEIRS OF HENRY B. CASNER, Deceased, 52 West Main Street,
Plainfield, PA 17081. HELEN G. CASNER died on August 18, 2001 by operation of law title vests
solely in HENRY B. CASNER and HELEN G. CASNER is hereby released of liability pursuant to PA.
R.C. P. 1144. HENRY B. CASNER died on May 28, 2013 Intestate and is survived by His Heirs -at -Law
MELVIN BROWNAWELL, RICHARD BROWNAWELL, HENRY BROWNAWELL, GREGORY
CASNER and SUSAN DARR.
3. On October 26, 2001 mortgagor(s) made, executed and delivered a mortgage upon the Property
hereinafter described to DECISION ONE MORTGAGE COMPANY, LLC, which mortgage is recorded
in the Office of the Recorder of Deeds of Cumberland County on November 14, 2001 as Book 1738,
Page 4707. The mortgage has been assigned to: DEUTSCHE BANK TRUST COMPANY AMERICAS
F/K/A BANKERS TRUST COMPANY AS TRUSTEE FOR RASC 2002 -KS 1 by assignment of
Mortgage . Plaintiff is the real party in interest pursuant to an Assignment of Mortgage to Plaintiff
attached as Exhibit C. The Mortgage and Assignment(s) (if any) are matters of public record and are
incorporated by this reference in accordance with Pennsylvania Rule of Civil Procedure 1019(g); which
Rule relieves the Plaintiff from its obligation to attach documents to pleadings if those documents are
matters of public record.
4. The Property subject to the Mortgage is more fully described in the legal description set forth as Exhibit
"A" ( "Property ").
5. The mortgage is in default because the monthly payments of principal and interest are due and unpaid
for August 01, 2012 and each month thereafter and by the terms of the Mortgage, upon default in such
payments for a period of one month or more, the entire principal balance and all interest due and other
charges are due and collectible.
6. The following amounts are due to Plaintiff on the Mortgage as of July 2, 2013:

7. Plaintiff is not seeking a judgment of personal liability (or an " personam judgment) against the
Defendants in this Action but reserves its right to bring a separate Action to establish that right, if such
right exists. If Defendants have received a discharge of their personal liability in a Bankruptcy
proceeding, this Action of Mortgage Foreclosure is, in no way, an attempt to re- establish the personal
liability that was discharged in Bankruptcy, but only to foreclose the Mortgage and sell the Property
pursuant to Pennsylvania law.
8. Notice of Intention to Foreclose and a Notice of Homeowners' Emergency Mortgage Assistance has
been sent to Defendants by certified and regular mail, as required by Act 160 of 1998 of the
Commonwealth of Pennsylvania, on the date(s) set forth in the true and correct copy of such notice(s)
attached hereto as Exhibit `B ". The Defendants have not had the required face -to -face meeting within
the required time and Plaintiff has no knowledge of any such meeting being requested by the Defendants
through the Plaintiff, the Pennsylvania Housing Finance Agency, or any appropriate Consumer Credit
Counseling Agency.
WHEREFORE, Plaintiff demands a de terris judgment in mortgage foreclosure in the sum of $30,970.87,
together with interest at the rate of $7.39, per day and other expenses, costs and charges incurred by the Plaintiff
which are properly chargeable in accordance with the terms of the Note and Mortgage and Pennsylvania law,
including but not limited to attorney fees and costs, until the Mortgage is paid in full, and for the foreclosure of
the Mortgage and Sheriff's Sale of the Property.

Plaintiff, by and through its attorney, in support of its Motion for Substituted Service,
represents as follows:
1) Plaintiff is the holder of a mortgage upon the premises 52 West Main Street , Plainfield , PA,
17081, hereinafter, the "mortgaged premises".
2) Defendant, GREGORY CASNER, Solely in His Capacity as Heir of HENRY B. CASNER,
Deceased, HENRY BROWNAWELL, Solely in His Capacity as Heir of HENRY B. CASNER,
Deceased, MELVIN BROWNAWELL, Solely in His Capacity as Heir of HENRY B. CASNER,
Deceased, RICHARD BROWNAWELL, Solely in His Capacity as Heir of HENRY B.
CASNER, Deceased, SUSAN DARR, Solely in Her Capacity as Heir of HENRY B. CASNER,
Deceased and UNKNOWN HEIRS OF HENRY B. CASNER, Deceased, are the real owners of
the mortgaged premises.
3) Defendant, HENRY B. CASNER is deceased as of May 28, 2013. Upon information and belief,
no estate has been raised by the heirs of HENRY B. CASNER, Deceased. Accordingly, the identity
and whereabouts of the heirs of HENRY B. CASNER, Deceased, if any, cannot be ascertained by
Plaintiff.
4) Pursuant to Pa.R.C.P. 1144(a)(2)-(3) and (b), the heirs of Defendant, HENRY B. CASNER,
Deceased are necessary parties to the instant action.
5) Plaintiff will be unable to effect service of the Complaint in Mortgage Foreclosure upon
UNKNOWN HEIRS OF HENRY B. CASNER, Deceased unless Plaintiff is permitted to do so
pursuant to Pa.R.C.P. 430(a) and (b)(1) and (2).
6) The following investigation was conducted in a good faith attempt to ascertain the whereabouts of
the unknown heirs of HENRY B. CASNER, Deceased: See attached Affidavit.
WHEREFORE, Plaintiff prays that the Court enter the attached order allowing Plaintiff
to serve the Complaint upon UNKNOWN HEIRS OF HENRY B. CASNER, Deceased by publication,
posting and mailing.

MEMORANDUM OF LAW IN SUPPORT OF MOTION
FOR SUBSTITUTED SERVICE UNDER Pa.R.C.P. 430(a)
After the filing of the complaint, Plaintiff discovered that Defendant HENRY B. CASNER, is
deceased and no estate has been raised by his heirs, if any. Pursuant to Pa.R.C.P. 1144(a)(3) and (b), the
heirs of Defendant, HENRY B. CASNER, Deceased are necessary parties to the instant action.
As the heirs of Defendant, HENRY B. CASNER, Deceased are unknown, Plaintiff seeks a special
order of court, as provided in Pa.R.C.P. 430(a), which provides:
(a) If service cannot be made under the applicable rule the plaintiff may move the court
for a special order directing the method of service. The motion shall be accompanied by
an affidavit stating the nature and extent of the investigation, which has been made to
determine the whereabouts of the defendant and the reasons why service cannot be made.
The affidavit accompanying this motion sets forth the attempts by Plaintiff to locate the heirs of
the deceased Defendant, which affidavit fully complies with Pa.R.C.P. 430. See, Note to Rule 430. As
stated above, the heirs of Defendant, HENRY B. CASNER, Deceased are unknown, as no estate has been
raised. In this instance, the Court may permit publication against the heirs or assigns generally.
Pa.R.C.P. 430(b)(2) specifically provides:
(2) When service is made by publication upon the heirs and assigns of a named former
owner or party in interest, the court may permit publication against the heirs or assigns
generally if it is set forth in the complaint or an affidavit that they are unknown.
In summary, Plaintiff must join the unknown heirs of the deceased Defendant, HENRY B.
CASNER in order to properly prosecute its foreclosure action. Pa.R.C.P. 1144(a)(3) and (b). As
defendant's heirs are unknown, the rules of court provide for this honorable Court to issue a special order
approving alternative service by publication. Pa.R.C.P. 430(a) and (b)(2). Plaintiff respectfully requests
such an order be granted, to permit it to properly prosecute the instant foreclosure action.
CONCLUSION
This case involves unknown heirs, which are necessary parties to the instant mortgage
foreclosure action. Pa.R.C.P. 1144(a)(2)-(3) and (b). Plaintiff seeks leave of court to serve said unknown
heirs by alternate service. The Rules of Court specifically empower this honorable Court to grant the
requested relief. See, Pa.R.C.P. 430(a) and (b)(2). For these and the foregoing reasons, Plaintiff
respectfully requests this honorable Court enter the attached order permitting service upon the unknown
heirs by publication.
