No. 13-6258 Civil LORI L. SCHIFFER, Defendant COMPLAINT 1. Plaintiff is Waverly Woods I Condominium Association(hereinafter"Plaintiff' or "Waverly Woods I"). 2. Defendant is Lori L. Schiffer,an adult individual with current residence Manor Care Health Services, 940 Walnut Bottom Road,Carlisle,PA 17015. Through all times relevant to this matter, Defendant has acted through her Power of Attorney,Donald L. Schiffer, Jr. A copy of the Power of Attorney has been attached as Exhibit"A." Mr. Schiffer resides at 839 Melissa Court, Enola,PA 17025. 3. The Plaintiff is a non-profit corporation, formed as a Condominium Association pursuant to the Pennsylvania Uniform Condominium Act, 68 Pa. C.S. §3101 et seq. (the"Act"). 4. The Defendants' Property, 4621 North Progress Avenue, Harrisburg, PA 17110 (hereinafter"Property"), is located within the Waverly Woods I Condominium Association. 5. The Plaintiff is responsible for maintenance of certain common areas within the condominium. 6. Pursuant to the Act, the Plaintiff assesses certain common charges against each property within the development, including the Property owned by the Defendants. 7. Pursuant to Section 3315(a) of the Act, assessments against the Property become a lien against the Property from the time the assessments become due. 8. Section 3315(a) of the Act provides "fees, charges, late charges, fines and interest charged [to the property] . . . and reasonable costs and expenses of the association, including fees incurred in connection with the collection of any sums due,to the association by the unit owner or enforcement of the provisions of the declaration,bylaws,rules or regulations against the unit owner are enforceable as assessments under this section." 9. Defendant filed a Bankruptcy Petition under Chapter 7 of the Bankruptcy Code on March 23, 2012. Defendant was given a discharge in Bankruptcy on May 28, 2012. 10. The Defendants have failed to pay condominium association assessments since March 2012 totaling $2,297.00 as of October 10, 2013. 11. The Defendants have further failed to pay late fee assessments since March 2012 totaling $180.00. 12. The failure of the Defendants to pay assessments charged has caused the Plaintiff to take steps to collect the amount due. The Plaintiff has incurred collection fees,court filing fees and attorney fees to date totaling $956.98 as of October 10, 2013. 13. A true and correct copy of the breakdown of all charges as of October 10, 2013 due is attached hereto and incorporated herein as Exhibit"B." 2 14. On October 10,2013,the Plaintiff sought collection of the above-referenced fees and costs before Magisterial District Justice Richard S.Dougherty,and MDJ-09-1-03. As a result of that case,District Justice Dougherty awarded the Plaintiff a judgment of$2,453.65. A true and complete copy of this Judgment is attached hereto as Exhibit"C." 15. The Plaintiff has appealed this District Justice Judgment, which has caused this present de novo Complaint to be filed. A copy of the Defendant's Notice of Appeal is attached hereto as Exhibit"D." 16. Attached to the Defendant's Notice of Appeal is a proposed legal rationale for why District Justice Dougherty's decision was incorrect. Unfortunately, the section of the Bankruptcy Code, 11USC §523(16)is not the current law. This section was changed by the Bankruptcy Reform Act in 2005. 17. The currently effective section of I IUSC §523(a)(16)provides: A discharge under Section 727... of this title does not discharge an individual debtor from any debt- (16) for a fee or assessment that becomes due and payable after the order for relief to the membership association with respect to the debtor's interest in a unit that has condominium ownership...or a lot in a homeowner's association, for as long as the debtor or the trustee has a legal,equitable,or possessory ownership in such unit.... 18. The Defendant's unit is currently owned by the Defendant. No other parry has a legal or possessory ownership interest in the unit. 19. In accordance with the above referenced sections of the Act, the Plaintiff seeks to collect the following amounts from the Defendant: a. The facts suggest the defendant has a history of meeting her obligation in payment of association fees in a timely manner. In March of 2012 defendant was admitted to Manor Care Nursing facility where she continues residence. Defendant made her last payment of association fees on or about March 1,2012. The association fees continued to accrue from April 1, 2012 to December 1, 2012 in amount of$107.00 monthly. From January 1, 2013 through October 1, 2013 they accrued in amount of$112.00 monthly. In addition,there is a $10.00 per month "late fee" which is assessed at the 10th of each month. On March 23, 2012 the plaintiff filed for Chapter 7(bankruptcy) in United States Bankruptcy Court in the Middle District of Pennsylvania. Case No. 1:12-bk-01644-MDF. Creditor meeting had been scheduled for April 24, 2012. On June 28, 2012 United State Bankruptcy Judge, Mary D. France issued an order of DISCHARGE OF DEBTOR under§ 727,Title 11(Bankruptcy Code). The plaintiff made no attempt to collect any accrued fee(s)from defendant until this filing (CV-133-2013)on July 26, 2013. The plaintiff now requests judgment in amount of$3,433.98 representing all association fees, reasonable attorney fees, court costs, and administrative fees which have accrued since April 1, 2013. The defendant avers the judgment must be denied in favor of the discharge granted by the United States Bankruptcy Court on June 28, 2012. DISCUSSION AND JUDGMENT The case now to be decided in this court is resolved by proper and reasonable application of the United States Bankruptcy Code. The object of a Chapter 7 filing is to have a debtor receive discharge from as many debts as possible so that the individual debtor can continue life with the "fresh start"that Congress envisioned in enacting the Bankruptcy Code. Such discharge under§727 does not discharge an individual from any and all debt. 11 USC§ 523 enumerates various exceptions to discharge under specific sections of the bankruptcy code, to include exceptions to a §727 discharge. 11 USC§ 523 (a) §§ 16 provides for an exception for fees and assessments for condominiums which become due after the order for relief. Therefore this court shall award judgment in favor of the plaintiff for assessments, late fees,and reasonable attorney fees which accrued after the discharge order of June 28,2012 and inclusive of fees due up to date of this judgment. Judgment for"administrative fees" is denied. Judgment distribution as follows: condo assessment ($1,762.00), late fees($160.00), reasonable attorney fees ($400.00), court costs ($131.65).
