STIPULATION AGAIN ENS
THIS AGREEMENT made this d y of �0 / f, 2013, by
and between Maverick Homes L C, hereinafter - erred to as
Contractor,
AND
Justin L. Burger and Amanda L. Burger, husband and wife,
hereinafter referred to as Owner, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in Dickinson Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as 32
McCoy Lane, Carlisle, PA 17015 .
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1 . 00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic ' s liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
rlaintain any mechanic ' s liens or claims against the said buildings
r any of them, and agree that this instrument, waiving the right
f lien, shall be an independent covenant .

Exhibit A
ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland
County, Pennsylvania, Lot No. 109 on the Final Subdivision Plan of Callapatscink,
Phase Three, dated December 9, 2003, revised February 26, 2004 and further
revised June 17, 2004, prepared by Dawood Engineering, Inc., and recorded
November 2, 2005, in the Office of the Recorder of Deeds in and for Cumberland
County,Pennsylvania, in Plan Book 91,Page 84, the same being numbered as more
particularly described as follows:
BEGINNING at a point located on the northern right of way line of McCoy Lane
(50 foot wide right of way); thence along the dividing line between Lot No. 109 and
Lot No. 110, North 81 degrees 20 minutes 41 seconds West 316.68 feet to a point;
thence along the dividing line between Lot No. 109 and Lot No. 103, North 55
degrees 33 minutes 33 seconds West 80.83 feet to a point; thence along the dividing
line between Lot No. 109 and Lot No. 104, North 23 degrees 15 minutes 28 seconds
East 111.65 feet to a point; thence along the dividing line between Lot No. 108 and
Lot No. 109, South 81 degrees 20 minutes 41 seconds East 316.68 feet to a point;
thence along the southern (50 foot wide right of way), South 08 degrees 39 minutes
19 seconds East 150.00 feet to the point and place of BEGINNING.
LOT No. 109 is subject to all applicable notations and conditions set forth by final
subdivision plan approval of Callapatscink,Phase III as noted above.
BEING the same premises which Wilbert L. Diehl and Shryle M. Diehl and D&S
Custom Homes by deed dated 10/17/13 and recorded 10/21/13 in Instrument
#201334309 granted and conveyed unto Justin L. Burger and Amanda L. Burger,
husband and wife.
