This 1 ` amour t'incl'uded=3-" `hecks totaling 4307.85 (#1007-$1437.15/#1008- $1437.15/#1633-$1435.55). These checks were written by the defendant to the plaintiff for rent and were returned from the bank marked NSF. I have deducted these three checks from the judgment. Also-the plaintiff was seeking.a partial acceleration of rent to the lease term (end). I advised that I wouldn't entertain an acceleration until the defendant moves out and the landlord/plaintiff has the opportunity to mitigate the damages by re-renting the properties.;,, The plaintiff has the option to file a criminal complaint through the local police department for the 3 checks or he can allow the def. to make payments on the checks until restitution is paid in full. The plaintiff also can file a civil complaint for the remaining amount —tent up to the time it is re-rented. Both parties have agreed to this and are willing to work together.
