PETITION TO ACCEPT A GUARDIANSHIP TRANSFER FROM ANOTHER STATE AND APPOINT PLENARY GUARDIAN OF THE PERSON AND ESTATE OF WILLIAM D. FAULHABER, III IN PENNSYLVANIA TO THE HONORABLE JUDGE OF SAID COURT: 1. This Petition is being sought pursuant to the provisions of the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act, specifically 20 Pa.C.S. § 5922 therein, with regards to this Honorable Court's acceptance of a previous Guardianship appointment from another state (i.e. New Jersey). 2. On or about March 15, 2001,Mary Kreger (herein "Mary") was appointed as the Guardian of the Person and of the Estate of her brother, William D. Faulhaber, III (herein"Bill"), by the Surrogate's Court of Warren County, New Jersey. 3. Bill currently resides at_6 Gordon Lane, Blairstown,New Jersey 07825 (with a mailing address of P.O. Box 317, Blairstown, New Jersey 07825) but desires to return to Camp Hill, Pennsylvania where he previously resided during the late 1990s. 4. Bill is sixty-six (66) years of age having been born on October 10, 1946. C� 5. Bill is not married. C-- m c� TI 6. Bill does not have any.children. U - + Ci y `i 7. Bill is not a patient in a mental hospital provided however, Bill has been under the care of Dr. Gerald A. Groves, M.D. (herein"Dr. Groves"), of Hackettstown,New Jersey for approximately twelve (12) years. 8. Dr. Groves, a board certified psychiatrist, has opined that he is not able to determine whether or not Bill can care for his person without the need for a guardian based upon the fact that Dr. Groves has never treated Bill when he was independent. 9. Presently, Dr. Groves does not see a psychiatric reason for Bill "not to live independently at this time", provided however, that the process be gradual, allowing time for "adjustments and corrections", as per the attached Exhibit"A". 10. In advance of the Petition herein, a corresponding Petition to Terminate Guardianship with a final Accounting was advanced by Mary in New Jersey as further reflected in the attached Exhibit`B", subject however to the appointment of a successor Guardian upon Bill's relocation to Pennsylvania. 11. On or about September 16, 2013, the Surrogate's Court of Warren County, New Jersey executed the attached Provisional Order transferring guardianship to Pennsylvania as reflected in the attached Exhibit "C". 12. The Petitioner herein is Mark T. Silliker, Esq., a Pennsylvania attorney with experience in providing personal and financial care for incapacitated people, with his principal place of business located at 5922 Linglestown Road, Harrisburg, Pennsylvania 17112 (herein the "Petitioner"). 13. The name and address of the other person who would be an intestate heir of Bill is his sister, Mary Kreger(Bill's only living relative), whose mailing address is P.O. Box 317, Blairstown, New Jersey 07825. 14. Bill was never a member of the Armed Services of the United States and Bill is not receiving benefits from the United States Veterans Administration. 15. Petitioner respectfully asks that it he be appointed as the Plenary Guardian of Bill's Person and Estate. 16. The proposed guardian has no interests which are adverse to the interests of Bill. 17. Mary was previously appointed as the Guardian of Bill's Person and Estate based upon Bill's prior longstanding diagnosis with bipolar disorder.) 18. Based on Bill's condition, the appointment of a Guardian for his Person and his Estate is the least restrictive alternative. 19. The proposed guardian avers he is qualified to act as a guardian for Bill's Person and Estate. 20. Mary and her counsel, William J. Gold, Esquire, concur in the Petitioner's request to be appointed as the Guardian of Bill's Person and Estate. 21. The gross value of Bill's estate is reflected in the final Accounting advanced by Mary before the Surrogate's Court of Warren County,New Jersey as further reflected in the attached Exhibit`B". Contemporaneous with the submission of the Petition herein,Petitioner is arranging for Bill to have an updated Capacity Evaluation performed by Dr. Robert M.Howse,Jr. (herein"Dr.Howse"). Dr.Howse is a Physician for Geriatric Associates in Lancaster who has performed a number of Capacity Evaluations for Guardianship Proceedings(a copy of Dr. Howse's Curriculum Vitae is attached hereto and marked as Exhibit"D").Petitioner avers Dr.Howse's report will provide this Honorable Court with an update on Bill's limitations as well as set forth the parameters for the level of care Petitioner will need to provide as the local Guardian.In the interim,Petitioner hereby submits this Petition to Accept the Guardianship Transfer,consistent with 20 Pa.C.S. § 5922,to advance the procedural requirements of said Act. The Plaintiff and Guardian, Mary Kreger, P.O. Box 317, Blairstown, NJ 07825 i being 62 years old is the biological sister of Wiliam Debold Faulhaber III, who r was bom on October 10, 1946, and is presently 66 years old. 2. By °Order of Guardianship" entered on March 15, 2002, Mary Kreger was appointed as Guardian of the person and property of William Debold Faulhaber Ill. 3. Wiliam Debold Faulhaber III has never been married, has no known children, has no living parents and has no siblings other than his guardian, Mary Kreger. 4. Due to the needs of William Debold Faulhaber 111 which have increased over time and the expressed desire of William Debold Faulhaber Ill to return to his prior residence in Camp Hill, Pennsylvania, it is the Guardian Mary Kreger's considered opinion that she will no longer be able to adequately fulfill the duties of Guardian of the person and property of William Debold Faulhaber Ili. It is the Guardian's considered opinion that William Debold Faulhaber Ill continues to KT er,Mary(Verified Complaint)8-1-13 Paget are I need a Guardian of his person and property until such time as a Court of competent jurisdiction finds otherwise. 5. Mary Kreger contacted distant relatives and friends of William Debold Faulhaber iII to ascertain if anyone would be willing to serve as Guardian. To date, no relatives or friends have expressed a desire or Interest. However, William Debold Fauihaber III has contacted his ibmrier attomey, John Connelly, Esq., located in Harrisburg, PA, seeking help in establishing residence in Camp Hill, PA (where he lived prior to moving to New Jersey). Attorney Connelly and his law partner, Neil W. Yahn, Esq. (admitted to the New Jersey bar) have communicated with the Petitioner, through her attomey, William J. Gold, Esq., that "Keystone Guardianship Services° Is willing to provide Guardianship services for William Debold Faulhaber Ill. 6, William Debold Faulhaber Ill continues to suffer from longstanding diagnosis bipolar disorder and has been under continuous treatment from Dr. Groves of Hackettstown, NJ,for approximately the last 12 years. 7, Dr. Groves, by report dated June 26, 2013 (appended hereto as Exhibit A), offered his considered opinion as to whether or not it is necessary to continue the Guardianship. In essence, Dr.Groves°. . . recommend(s) a gradual transition . . . with the establishment of viable support." 6. It is the Petitioner's expectation that with the present involvement of William Fauihaber's attorneys, John Connelly and Neil Yahn, together with the Keystone Guardianship Service, that a "gradual transition° and °viable support" recommended by Dc Groves will be accomplished and William Faulhaber's desire to return to Camp Hill, PA, can be effectuated. (See annexed letter of John Connelly, Esq.) 9. The Petitioner, with all due respect, leaves it to the Courts, based upon competent psychiatric testimony, to decide whether or not a Guardian of the person and/or properly is still required. KrWr,Mary(verified Complaint)8-1-13 P"e2 ol9 10. it is further the Petitioner's understanding and request that this Court will enter a Provisional Order requesting the Court of Common Pleas, Cumberland County Orphan's Court, Pennsylvania, to hold a hearing on the issue of competency/ guardianship and based upon competent psychiatric testimony determine the type of Guardianship that is most appropriate for William Faulhaber in his present state of mind. 11. This Petition for a Final Order is being sought pursuant to the provisions of the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act, specifically 20 Pa.C.S. § 5922 therein, with regards to this Honorable Court's acceptance of a previous Guardianship appointment from another state (i.e. New Jersey). 2. On or about March 15, 2001, Mary Kreger(herein"Mary") was appointed as the Guardian of the Person and of the Estate of her brother, William D. Faulhaber, III (herein"Bill"), by the Surrogate's Court of Warren County, New Jersey. 3. Bill is sixty-seven (67) years of age having been born on October 10, 1946. 4. Bill is not married. 5. Bill does not have any children. 6. Bill currently resides at 122 November Drive, Apartment 6, Camp Hill, Pennsylvania 17011. 7. On or about August 12, 2013, Mary advanced a Petition to Terminate Guardianship, with a final Accounting in Warren County,New Jersey as further reflected in the attached Exhibit"A", subject however to the appointment of a successor Guardian upon Bill's relocation to Pennsylvania. 8. On or about September 16, 2013, the Surrogate's Court of Warren County, New Jersey executed the attached Provisional Order transferring guardianship to Pennsylvania as reflected in Exhibit"B". 9. Accordingly, on or about October 31, 2013, Mark T. Silliker, Esq., a Pennsylvania attorney with experience in providing personal and financial care for incapacitated people, with his principal place of business located at 5922 Linglestown Road, Harrisburg, Pennsylvania 17112 (herein the "Petitioner"), advanced the corresponding Petition to Accept Guardianship Transfer before this Honorable Court. 10. Silliker, Esquire (herein"Petitioner"), the appointed Plenary Guardian for William D. Faulhaber, III (herein"Bill"),by and through his attorneys, JSDC LAW OFFICES, who hereby alleges upon valid information and belief as follows: 1. On or about March 5, 2014, Petitioner was appointed by this Honorable Court as Plenary Guardian of the Person and Estate for Bill following his transfer from Warren County, New Jersey (a true and correct copy of the Court's Order dated March 5, 2014 is attached hereto and marked as Exhibit"A"). 2. Consistent with the aforementioned Order, a Review Hearing for the Guardianship was scheduled for Friday, May 30th, 2014 at 11:00 a.m. (see Exhibit"A"). 3. Petitioner respectfully requests that this Honorable Court continue the Review Hearing as Petitioner avers said proceeding conflicts with another matter. 4. In addition, given that it has only been three (3) months since the appointment of Petitioner as Plenary Guardian, very little has changed in Bill's health and/or financial status, although Bill appears to be doing very well and a nurse's aide has been assisting Bill with his daily living functions. 5. Bill continues to reside at 122 November Drive, Apartment 6, Camp Hill, Pennsylvania 17011 and is receiving the requisite care via the nurse's aide to assist in Bill's activities and tasks of daily living. 6. As such, in the interest of the Court's time and Bill's finances, Petitioner avers a status update at the Review Hearing is unnecessary at this time given the aforementioned conflict and as the matter further develops, a more productive use of the Court's time would be to continue the Review Hearing to complete additional evaluations and an accounting. 7. Petitioner avers rescheduling the Review Hearing for in or about One Hundred Twenty(120) days would be sufficient time to provide this Court with an appropriate update on Bill's health and financial status, including presentation of an Interim Accounting at said time. 8. Given that Petitioner, as the Plenary Guardian for Bill, is the only party to this matter, the Motion herein is uncontested.
