Opinion: Branden Borden v. Transport Drivers, Inc.
The testimony and the exhibits provided at the hearing on July 23, 2013 indicated
that Branden Borden had been employed by Transport Drivers, Inc. ( "TDI ") to an
account with Harley Davidson through UPS Freight. The job ended when another
employee of UPS insisted, on the afternoon of March 11, 2013, that Mr. Borden be
immediately removed from the account. Bill O'Connell, from TDI, then contacted Mr.
Borden to tell him that he was being removed, and that TDI would look for other work
for him. Mr. Borden continued to do work with the account through March 19, 2013,
when he was permanently terminated by TDI.
It is clear that as of the afternoon of March 11 th , Mr. Borden was aware that he
was no longer working on the Harley Davidson account. However, he continued to do
work on the account, which benefitted UPS, and ultimately, TDI.
The failure to compensate Mr. Borden for any of this work would be an unjust
enrichment for the companies who continued to work with him, send him invoices to
approve, and generally make use of his services. Not only did they remove his access to
the database, but they continued to include him on work emails and invoice requests.
However, Mr. Borden knowingly chose to continue doing this work, knowing that he was
no longer welcome.
The Court finds that Mr. Borden is entitled to payment for March 11 th , as his
removal was not even requested until 2:48 p.m. Furthermore, the Court finds that the
balance of fairness results in his being paid for two more days of work.
As a result of the foregoing, Judgment is for the Plaintiff in the amount of
$718.79, plus one -half of the court costs, for a total Judgment of $768.29.
It is so ORDERED.
