V. CIVIL ACTION — LAW MIRANDA- JONES, Defendant JURY TRIAL DEMANDED COMPLAINT 1. Plaintiffs Mary "Ellen and Justin Caporiccio are adult individuals and citizens of the Commonwealth of Pennsylvania who reside in Mechanicsburg, Cumberland County, Pennsylvania. 2. Defendant Miranda Jones is an adult individual and citizen of the Commonwealth of Pennsylvania who resides at 1216 Mitchell Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17050. 3. The facts and occurrences hereinafter related took place on or about April 30, 2012, at the intersection of Hogestown Road and Mulberry Drive, Silver Spring Township, Cumberland County, Pennsylvania. 4. At that time and place, Plaintiff Mary Ellen Caporiccio was operating her 2007 Subaru Outback; traveling south on Hogestown Road. 5. At the same time and place, Defendant Miranda Jones was operating a Honda Civic traveling east on Mulberry Street, planning to turn left and travel north on Hogestown Road. 0 529708 ,y 6. Defendant Jones pulled her Honda from the stop sign directly in front Mrs. Caporiccio's Subaru, causing a motor vehicle collision. 7. The foregoing collision and all of the injuries and damages set forth herein sustained by Plaintiffs Mary Ellen and Justin Caporiccio are the direct and proximate result of the negligent, careless, wanton, and reckless manner in which Defendant Miranda Jones operated her motor vehicle as follows: a. failure to yield the right -of =way; b. failure to keep alert and maintain a proper watch for the presence of other motor vehicles on Hogestown Road; C. failure to see Mrs. Caporiccio's vehicle before attempting to turn; and d. driving her vehicle upon the highway in a manner endangering persons and property and in a reckless manner with careless disregard to the rights and safety of others and in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania. CLAIM I Mary Ellen Cqporiccio.v. Miranda Jones 8. Paragraphs 1 through 7 of the Complaint are incorporated herein by reference. 9. Plaintiff Mary Ellen Caporiccio sustained painful and severe injuries, which include but are not limited to trauma to her chest, left hand (dominant hand) and in particular her. hand became so swollen and painful, her rings needed to be cut off. 10. By reason of the aforesaid injuries sustained by Mary Ellen Caporiccio, she was forced to incur liability for medical treatment, and claim is made therefor. 529708 2 11. Because of the nature of her injuries, Mary Ellen Caporiccio has been advised and, therefore, avers that she may be forced to incur similar expenses in the future, particularly. i• with regard to surgery of her left thumb, and claim is made therefor. 12. Mary Ellen Caporiccio has undergone and in -the future may undergo physical and mental suffering, inconvenience in carrying out her daily activities, sleep disturbance, loss of life's pleasures and,enjoyment, and claim is made therefor. 13. Mary Ellen Caporiccio's injured hand is her dominant hand that has adversely impacted her job as a school teacher, such as writing, correcting papers and typing. 14. Mary Ellen Caporiccio continues to be plagued by persistent pain and limitation. of her left hand and avers that her injuries may be of a permanent nature, causing residual" problems for the remainder of her lifetime, and claim is made therefor. CLAIM II Justin Caporiccio v. Miranda -Jones 15. Paragraphs 1 through 14 of the Complaint are incorporated herein by reference. 16. As a result of the aforementioned injuries sustained by his wife, Plaintiff Mary Ellen Caporiccio, Plaintiff Justin Caporiccio has been and may in the future be deprived of the care, companionship, consortium, and society of his wife, all of which will be to his great detriment, and claim is made therefor. WHEREFORE, Plaintiffs Mary Ellen and Justin Caporiccio demand judgment against Defendant Miranda Jones in an amount in excess of Fifty Thousand Dollars ($50,000.00), 529708 3 exclusive of interest and costs and in excess of any jurisdictional amount requiring compulsory arbitration.
