CLAY Owners MUNICIPAL LIEN MUNICIPAL LIEN FOR SERVICES AND SEWER RATES AND NOW, comes Monroe Township Municipal Authority, of 1220 Boiling Springs Road, Mechanicsburg, Pennsylvania, by and through its Solicitor, Michael J. Pykosh, Esquire, and files the following municipal claim against Steven W. Clay and Catherine M. Clay, owning property located at 1297 Asper Drive, Boiling Springs, Pennsylvania 17007. Steven W. Clay and Catherine M. Clay, are the owners of all that certain lot of ground, including any improvements thereon, being more fully described as follows: ALL THAT CERTAIN tract or parcel of land and premises, situate, lying and being in the Township of Monroe in the County of Cumberland and Commonwealth of Pennsylvania, more particularly described as follows: BEGINNING at a point on the Eastern line of Asper Drive (50 feet wide), at the line dividing Lot Nos. 57 and 56 as shown on said Plan and in the center of a 30 foot wide water line easement; thence from said beginning point by the Eastern line of Asper Drive by a curve to the left having a radius of 175 feet the arc length of 96.21 feet and a chord length of 94.87 feet measured on a chord bearing of North 26 degrees 29 minutes West to a point; thence by the line dividing Lot Nos. 55 and 56 as shown on Plan North 41 degrees 34 minutes East 294 feet to a point; thence by other property now or formerly of Penn Products Corporation South 21 degrees 18 minutes East 260.23 feet to a point in the line dividing Lot Nos. 56 and 57 as shown on said Plan and in the center of a 30 feet wide water line easement; thence by the dividing line between Lot Nos. 56 and Ow l acl 57 and the center of said 30 feet wide water line easement, South 75 degrees 50 minutes West 255 feet to the place of BEGINNING. UNDER AND SUBJECT to the building lines, covenants, restrictions and reservations as recorded with the Plan of Lots of Section "A" of White Rock Acres in Plan Book 20, Page 40. BEING THE SAME PREMISES which Herl R. Prutzman, Jr., by his Attorney -in -Fact Scott K. Prutzman, by Deed dated July 1, 2004 and recorded July 8, 2004 at the Recorder of Deeds Office in Cumberland County, Pennsylvania, in Book 264, Page 208, granted and conveyed unto Steven W. Clay and Catherine M. Clay, husband and wife TAX PARCEL NO. 22-33-0043-016 Monroe Township Municipal Authority hereby files this Municipal Lien for Services and Sewer. Rates levied and assessed from through and including. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02 -04, same being known as a Resolution of the Board of Monroe Township Municipality Authority imposing user charges to be collected from the owner of each improved property served or to be served by the Authority's sewer system, in conjunction with all prior relevant Resolutions and Ordinances, including, but not necessarily limited to, Monroe Township Ordinance No. 3 of 1978 and Monroe Township Ordinance No. 99 -6, as amended; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to for sewerage due to be treated from July 1, 2013 through September 30, 2013, which services total is in the amount of six hundred nine and 00 /100 ($609.00) dollars, which sum was duly assessed against, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10 %) percent; along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above - described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens). Clay 1297 Asper Drive Boiling Springs, PA 17007 Dear Mr. Clay: I am contacting you on behalf of Monroe Township relative to your sewer account #203 for real estate owned by you, same being known and numbered as 1297 Asper Drive, Boiling Springs, PA 17007. This account is delinquent. As of the, last billing notice, same being dated August 15, 2013, the delinquency is in the amount of $638.00. The purpose of this letter is to give you the following three options regarding your past due account: A. Full Payment of the entire outstanding balance to be made within ten (10) days of the date of this letter; B. Contact the Authority to set up a Payment Agreement of a minimum of $100.00 per month on account of the arrears and required to keep up with all quarterly charges billed thereafter. The Agreement must be finalized within ten (10) days of the date of this letter; C. The lien /sheriff's sale process will immediately commence if there is no communication from the owner to set up and complete either option A or B within ten (10) days of the date of this letter. Option C will result in filing fees, service costs, and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed at the current rate. The imposition of assessment of attorney's fees may be avoided by you making payment in full or executing a Payment Agreement within ten (10) days of date of this letter.
