Pykosh, Esquire, and files the following municipal claim against Clayton W. Gauker, Jr., owning property located at 912 Nixon Drive, Mechanicsburg, Pennsylvania 17055. Clayton W. Gauker, Jr. is the owner of all that certain lot of ground, including any improvements thereon, being more fully described as follows: ALL THAT CERTAIN piece or parcel of land situate in Monroe Township, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a point on the northern line of Nixon Drive, said point being five hundred forty -two (542) feet in a westerly direction from the center line of Legislative Route No. 21017; thence continuing along Nixon Drive, South 70 degrees 30 minutes West eighty -four and eighty -five one - hundredths (84.85) feet to a point; thence North 10 degrees 21 minutes West, two - hundred sixty -one (261) feet to a point on line of lands now or late of Regent Construction Company; thence along said lands, North 70 degrees 32 minutes East, eighty-five and two tenths (85.2) feet to a point; thence South 10 degrees 16 minutes East, two hundred sixty -one (261) feet to a point on the northern line of Nixon Drive, the place of BEGINNING. HAVING thereon erected a frame dwelling numbered 912 Nixon Drive. BEING THE SAME PREMISES which Denise E. Wilson, n/k/a Denise e E. Stine, joined by Christopher D. Stine, her husband, by Deed dated September 'P 26, 2005 and recorded October 18, 2005 at the Recorder of Deeds Office in Cumberland County, Pennsylvania, in Book 271, Page 2394, granted and conveyed unto Clayton W. Gauker, Jr. TAX PARCEL NO. 22-24-0783-007 Monroe Township Municipal Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from through and including. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02 -04, same being known as a Resolution of the Board of Monroe Township Municipality Authority imposing user charges to be collected from the owner of each improved property served or to be served by the Authority's sewer system, in conjunction with all prior relevant Resolutions and Ordinances, including, but not necessarily limited to, Monroe Township Ordinance No. 3 of 1978 and Monroe Township Ordinance No. 99 -6, as amended; and providing for payment and collection of such user charges.. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to for sewerage due to be treated from July 1, 2013 through September 30, 2013, which services total is in the amount of four hundred ninety -three and 501100 ($493.50) dollars, which sum was duly assessed against, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10 %) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above - described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens). This account is delinquent. As of the last billing notice, same being dated August 15, 2013, the delinquency is in the amount of $517.00. The purpose of this letter is to give you the following three options regarding your past due account: A. Full Payment of the entire outstanding balance to be made within ten (10) days of the date of this letter; B. Contact the Authority to set up a Payment Agreement of a minimum of $100.00 per month on account of the arrears and required to keep up with all quarterly charges billed thereafter. The Agreement must be finalized within ten (10) days of the date of this letter; C. The lien /sheriffs sale process will immediately commence if there is no communication from the owner to set up and complete either option A or B within ten (10) days of the date of this letter. Option C will result in filing fees, service costs, and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed at the current rate. The imposition of assessment of attorney's fees may be avoided by you making payment in full or executing a Payment Agreement within ten (10) days of date of this letter.
