Plaintiff is Flagstar Bank, FSB, duly organized and doing business at the above - captioned address. 2. The Defendant is Joel A. Williams, who is a mortgagor and real owner of the mortgaged property hereinafter described, whose last -known address is 1540 Fox Hollow Circle, Mechanicsburg, PA 17055. 3. The Defendant is Beth A. Williams, who is a mortgagor and real owner of the mortgaged property hereinafter described, whose last -known address is 1540 Fox Hollow Circle, Mechanicsburg, PA 17055. 4. On May 31, 2008, Joel A. Williams and Beth A. Williams, mortgagors, made, executed and delivered a mortgage upon the premises hereinafter described to Mortgage Electronic Registration Systems, Inc., solely as nominee for Flagstar Bank, FSB, its successors and assigns which mortgage is recorded in the Office of the Recorder of Cumberland County as Instrument Number 200819418 (the "Mortgage "), such Mortgage being incorporated herein by reference pursuant to Rule 1019(g) Pa. R. C. P. 5. On February 22, 2011, the Mortgage was assigned by Mortgage Electronic Registration Systems, Inc. to Flagstar Bank, FSB, by Assignment of Mortgage, recorded in the Office of the Recorder of Cumberland County as Instrument Number 201107227, such Assignment of Mortgage being incorporated herein by reference pursuant to Rule 1019(g) Pa. On September 16, 2010, the Defendant, United States ofAmerica, acquired a lien against the premises hereinafter described in the sum of $28,852.72, subordinate to the mortgagee hereinafter referred to, by reason of Federal Tax Lien, Docket Number: 2010- 06170, in favor of the United States of America against Joel A. & Beth A. Williams, and which is recorded in the Office of Prothonotary of Cumberland County, Pennsylvania. 7. Notice of this lien was filed on September 27, 2010, at the Office of the Prothonotary of File # 75836 Page 3 Cumberland County, by the United States Department ofthe Treasury, Internal Revenue Service, Harrisburg, Pennsylvania. A true and correct copy ofNotice of Federal Tax Lien is attached hereto and marked as Exhibit 8. By the filing of this action, Plaintiff seeks a judicial sale of the premises hereinafter described. 9. The premises subject to said mortgage is described in the legal description attached as Exhibit "B" and is known as 1540 Fox Hollow Circle, Mechanicsburg, Pennsylvania 17055. 10. The mortgage is in default because monthly payments of principal and interest upon said mortgage due March 1, 2013 and each month thereafter are due and unpaid, and by the terms of said mortgage, upon default in such payments for a period of one month, the entire principal balance and all interest due thereon are collectible forthwith. 11. The following amounts are due on the mortgage: Principal Balance $ 330,218.73 Interest through November 11, 2013 $ 17,007.09 (Plus $59.94 per diem thereafter) Late Charges $ 1,456.65 Attorney's Fee $ 1,650.00 GRAND TOTAL $ 350,332.47 The attorney's fees set forth above are in conformity with the mortgage documents and Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriff's sale.
