WHEREAS, CHARLES W. BRAIN AND JANICE C. BRAIN, are about to execute
contemporaneously herewith a contract with TAMANINI HOMES, LLC, for the erection of a dwelling
upon a lot of land situate in:
Monroe Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which is attached hereto and made a part hereof known as Lot 53, Section 1, Phase 2,
Trindle Station, 823 Tamanini Way, Mechanicsburg, PA 17055
Now, 1$ /o2 (4P , 2013, at the time of and immediately before the execution of the principal contract,
and before any authority has been given by the said owners to the said contractor to commence work on
the said building, or purchase materials for the same in consideration of the making of the said contract
with contractor and the further consideration of One ($1.00) Dollar to contractor paid by owner, it is
agreed that no lien shall be filed against the building and /or land by the contractor, or any subcontractor,
nor by any of the material men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.

The land referred to in this Commitment is described as follows:
ALL THAT CERTAIN tract or parcel of land situated in Monroe Township, Cumberland County, Pennsylvania,
being Lot 53 as described on a plan title "Final Subdivision Plan for Lots 46 -54, Trindle Station, Section 1, Phase
II," dated November 19, 2009, last revised April 14, 2010 by Alpha Consulting Enginerrs, Inc. and recorded in
Cumberland County Courthouse, Instrument Number 201014375, more particularly described as follows:
BEGINNING at a point at Lots 52 & 53 of the aforementioned plan and along southern right of way of Tamanini
Way, said point being South 24 degrees 54 minutes 58 seconds East a distance of 71.58 feet from a point at
Lots 20 & 21 and along the northern right of way of Tamanini Way; thence along Lot 52 South 20 degrees 46
minutes 30 seconds West a distance of 118.03 feet to a point at lands now or formerly of Trindle Station LLC;
thence along lands now or formerly of Trindle Station LLC North 68 degrees 05 minutes 30 seconds West a
distance of 100.09 feet to a point at Lot 54; thence along Lot 54 North 20 degrees 46 minutes 30 seconds East a
