PETITION TO WITHDRAW AS COUNSEL
AND NOW, comes counsel, R. Mark Thomas, Esquire, Petitioner herein, and files this
Petition for withdrawal of his appearance as counsel for the Estate in the above-captioned matter,
and in support thereof, respectfully represents:
1. Mildred R. Rutter died on July 19, 2013, leaving a last will and testament
appointing her son, Leonard A. Rutter, Jr. as Executor.
2. On or about August 14, 2013, a Petition was filed to have Leonard A. Rutter, Jr.
appointed as Executor, said Petition being prepared by Petitioner as counsel for the estate.
3. Shortly after opening the estate, Petitioner advised Leonard A. Rutter, Jr.,
Executor that Petitioner would not be able to continue as counsel for the estate.
4. Petitioner advised Leonard A. Rutter, Jr., Executor, that he should obtain new
counsel to represent him in the handling of his deceased mother's estate.
5. To date, Leonard A. Rutter, Jr., Executor, has not obtained new counsel or if he
has obtained new counsel, new counsel has not entered an appearance on behalf of Leonard
A. Rutter, Jr.

6. Your Petitioner has not heard from Leonard A. Rutter, Jr., Executor, since August
2013, when Petitioner advised Mr. Rutter that he was no longer willing to represent the
estate.
7. A copy of this Petition to Withdraw Appearance is being served on the Executor
by mailing same on even date with the filing of this Petition.
THEREFORE, your Petitioner prays this Honorable Court will enter a Rule directing
Leonard A.Rutter, Jr., to show cause, if any, as to why this Petition to Withdraw Appearance
should not be granted.
