The Borough of Mechanicsburg, Cumberland County, Pennsylvania, hereby files its claims against
Thomas P. Guzmich and all that certain lot or piece of ground situated in the Borough of Mechanicsburg,
Cumberland County, Pennsylvania, being known generally as 11 West Coover Street, Mechanicsburg, with a
tax parcel number 16 -24- 0787 -065 and more specifically described in Exhibit A attached and having thereon
erected a house.
For curb and sidewalk repairs for 11 West Coover Street: $5,861.00
Together with an additional ten percent (10 %) penalty: $586.10
Solicitor filing fee: $125.00
Total: $6,572.10
Together with court filing costs and interest sec. leg. from August 15, 2013, the date of
completion of the work.
Prior notice in accordance with law was served upon the owner by first class United States mail,
postage prepaid, at the owner's address at 11 West Coover Street in Mechanicsburg, PA 17055 on February
13, 2013, as shown in Exhibit B attached. The said services were provided by the Borough of Mechanicsburg
and the charge levied therefor in strict accordance with Article XVIII of the Borough Code, Act of February 1,
1966, P.O. 1655 (1965), No. 581, Section 1801 et. seq., 53 P.S. Section 46801 et. sea., Ordinance 892, Part 4 of
Chapter 21 and /or Part 9 of Chapter 1 of the Code of Ordinances of the Borough of Mechanicsburg.

WHEREAS, the said ROBERT S. GUZMICH, was vested in his lifetime with title to an undivided
one -half (1/2) interest in and to the premises hereinafter described in the Borough of Mechanicsburg,
Cumberland County, Commonwealth of Pennsylvania; and
WHEREAS, the said ROBERTS. GUZMICH died, testate, on the 23rd day of August, 2002, and
Letters Testamentary were duly issued to the said THOMAS P. GUZMICH, as Executor, by the
Register of Wills of said Cumberland County, docketed to No. 21 -02 -796; and
WHEREAS, the lands herein - mentioned were not specifically devised.
NOW, THEREFORE, THIS INDENTURE WITNESSETH, that the said THOMAS P. GUZMICH,
Executor, as aforesaid, for and in consideration of the sum of ONE and No /100 ($1.00) DOLLAR
and other good and valuable considerations, to him in hand paid by the said Thomas P. Guunich, at
and before the ensealing and delivery hereof, the receipt whereof is hereby acknowledged, has
granted, bargained, sold, aliened, released, and confirmed, and by these presents, by virtue of the
power and authority in him vested, does grant, bargain, sell, alien, release, and confirm unto the
Grantee, his heirs and assigns, all of said decedent's undivided one -half (1/2) interest in and to the
said premises herein described below, as follows, to wit:
ALL THAT CERTAIN House and Lot of Ground situate in the First Ward of the
Borough of Mechanicsburg, County of Cumberland and State of Pennsylvania,
bounded and described as follows, to wit:
BEGINNING at a post at the corner of a twenty (20) foot alley and West Coover
Street; thence Westward along said Street, sixty -eight (68) feet to line of property
now of Mearl J. Shettel and Florence B. Shettel, his wife; thence along said line
Southward, one hundred and forty (140) feet to line of a twenty (20) foot alley;
thence Eastward along said alley, seventy -seven (77) feet to a post on the corner of
the first mentioned alley; thence Northward along said alley, one hundred and forty
(140) feet to the place of BEGINNING.
HAVING thereon erected a single family frame dwelling house numbered 11 West
Coover Street, Mechanicsburg, Pennsylvania.
TITLE HISTORY:
BEING THE SAME PREMISES which Paul P. Sopensky and Emily L. Sopensky, his wife, by their
deed dated May 6, 1968 and recorded in the office of the Recorder of Deeds in and for Cumberland
Ct'2i;

County, Pennsylvania, in Deed "T," volume 22, page 507, granted and conveyed to Stephen C.
Guzmich and Mary M. Guzmich, his wife. The said Mary M. Guzrnich departed this earthly life on
October 5, 1972 whereupon full and absolute title vested in the said Stephen C. Guzmich, her
surviving widower, by the laws of the Commonwealth of Pennsylvania incident to tenancies by the
entireties.
SUBSEQUENTLY, the said Stephen C. Guzmich, then being an unremarried widower, by his deed
dated February 24, 1986, and recorded in the Recorder's Office aforesaid in Deed Book "T ", volume
31, page 93, granted and conveyed the said premises to Robert S. Guzmich, Thomas P. Guzmich, and
Charles Guzmich, his three (3) sons, vesting in each an undivided one -third (1/3) interest thereof as
tenants in common.
SUBSEQUENTLY, the said Charles Guzmich, a married man, unjoined by his wife, the aforesaid
Donna,K.Tuzmich, by his deed dated March 5, 1986, and recorded in the Recorders' Office aforesaid
in Deed Book "T ", volume 31, page 482, granted and conveyed all of his undivided one -third (1/3)
interest in the said premises to his two (2) brothers, the said Robert S. Guzmich and Thomas P.
Gu2mich.
AS IS RELATED more fully above, the said Robert S. Guzmich has since departed this earthly life
and his last will has been duly probated and letters testamentary duly issued thereon. Item 2 of the
said last will reads as follows:
"All the rest, residue, and remainder of my Estate, real, personal and mixed, whatsoever and
wheresoever situate, I give, devise, and bequeath to my brother, Thomas P. Guzmich, to his own use
and benefit absolutely."
In fulfillment of said gift, devise, and bequest the said executor makes this grant and conveyance to
the said grantee of the said decedent's undivided one -half (1/2) interest. Thus consolidating full and
absolute title in the said grantee.
During his lifetime, the said Robert S. Guzmich had declared bankruptcy and successfully completed a
Chapter 13 Plan and obtained a discharge. All of which more fully appears at large in docket file 00-
01771JJT-1 in the United States Bankruptcy Court of the Middle District of Pennsylvania, as is
more particularly evidenced by that certain official discharge signed on September 26, 2002 by the
Honorable John J. Thomas, United States Bankruptcy Judge.
Additionally, the said Executor filed a First and Final Account Including Proposed Distribution with
the Orphans' Court of Cumberland County, Pennsylvania, which said Account was fully and
unconditionally confirmed by said Court on November 25, 2003. Amongst the proposed distribution
was the interest in these premises being herein conveyed.
The said Donna M. Guzmich, the wife of the said Charles Guzmich, joins herein for record title
purposes only since she had not joined in the aforesaid deed of her said husband. She makes no claim
to any interest in the premises by virtue of her marriage or otherwise and she makes no
representations as to the premises or the title thereto nor does she join in the warranty herein
provided.
THIS TRANSFER IS REALTY TRANSFER TAX EXEMPT AS A TRANSFER BETWEEN SPOUSE
OF A BROTHER AND BROTHER PER SECT. 1102.C.3.(6) AND AS A TRANSFER OF
PROPERTY PASSING BY TESTATE SUCCESSION FROM THE PERSONAL
REPRESENTATIVE OF A DECEDENT TO DECEDENT'S DEVISEE PER SECT. 1102.C.3.(7).
TO HAVE AND TO HOLD the said messuage or tenement and tract of land, hereditaments and
premises hereby granted and released, or mentioned and intended so to be, with the appurtenances
unto the said Grantee, his heirs and assigns, to and for the only proper use and behoof of the said
Grantee, his heirs and assigns, forever.
AND THE SAID GRANTOR, Executor as aforesaid, his heirs, executors and administrators, do
covenant, promise and agree to and with the said Grantee, his heirs and assigns, by these presents,
that the said Executor /Grantor has not done, committed any act, matter or thing whatsoever
whereby the premises hereby granted, or any part thereof, is, are, shall or may be impeached, charged
or encumbered in title, or otherwise howsoever.
