Mumma � N 'n No. 1003 MDA 2013, 1027 MDA 2013 1028 MDA 2013 and 1222 MDA 2013 Dear Ms. Farner Strasbaugh: I am responding to your inquiry as to whether, for the purpose of providing this Court with the certified record for the above-named appeals, it might be possible to avoid the expense and inconvenience of sending nine boxes of exhibits and transcripts by sending instead a jump drive containing th�s? materials. Unfortunately, pursuant to Pennsylvania Rule of Appellate Procedure 1921, the Superior Court cannot accept anything other than the actual exhibits and transcripts as part of the certified record. Even if the documents in question had been filed electronically with your office, Rule 1921 would require that hard copies of the documents be prepared for inclusion in the certified record. Pursuant to Pennsylvania Rule of Appellate Procedure 1931(c), however, '�[d]ocuments of unusual bulk or weight and physical exhibits other than documents shall not be transmitted by the clerk unless he or she is directed to do so by a party or by the prothonotary of the appellate court." I have conferred with the President Judge concerning the Rule's application in this case and we have agreed that, at this juncture, the nine boxes of documents in question need not be sent to the Superior Court. If the panel assigned to hear the case should decide otherwise in the future, you may wish to avoid the cost of a commercial carrier by having a member of your staff transport the materials to the Prothonotary's Office for the Middle District, located in the Pennsylvania Judicial Center in Harrisburg, where the Prothonotary's staff can assist in unloading the materials.
