On or about January 31, 2007, Vince Stouffer and Eowyn Glass executed to Taylor, Bean & Whitaker Mortgage Corp. a seconday Mortgage Loan (herein "Note) under the account XXX8472. The sum of $ 36,000.00 was financed with an interest rate of 8.8750 %. (See Exhibit "A ") 4. The Note was endorsed to Bank of America, N.A from Taylor, Bean & Whitaker Corp. Plaintiff is the holder of the Note. (See Exhibit "A ") 5. Bank of America, N.A appointed Green Tree Servicing, LLC as its attorney -in- fact for purposes of enforcement of the the Note by granting a Limited Power of attorney. (See Exhibit "B ") 6. Under the terms of the Note, the Defendants were required to make prompt and regular payments. 7. The Note is in default due to the failure of the Defendants to make monthly payments as they became due and owing. The Defendants' last payment was received on or about April 5, 2010.
