STIPULATION AGAINST LIENS
WHEREAS, Vijay N. Cheleenahalli and Naga Kalpana Pilli, husband and wife of
Pennsylvania, is about to execute contemporaneously herewith, a contract with J. W. Mumper
Construction, Inc., a Pennsylvania Corporation of Cumberland County, Pennsylvania, for the
erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN tract of land situate in Township of Silver Spring,
County of Cumberland, and Commonwealth of Pennsylvania, more particularly bounded and
described as follows, to wit:
BEGINNING at a point on the eastern side of Antietam Court at the comer of Lot
No. 71 of the hereinafter mentioned plan of lots; THENCE by Lot No. 71 South 82 degrees 59
minutes 37 seconds East, a distance of 232.90 feet to a point at lands now or late of Becker;
THENCE by same South 08 degrees 03 minutes 05 seconds West, a distance of 260.17 feet to a
point at the corner of Lot No. 69 of the hereinafter mentioned plan of lots; THENCE by same
North 62 degrees 08 minutes 58 seconds West, a distance of 183.17 feet to a point on eastern
line of Antietam Court; THENCE by same by a curve to the left having a radius of 95.00 feet, an
are length of 119.92 feet to a point; THENCE by same by a curve to the right having a radius of
60.00 feet, an arc length of 53.78 feet to a point; THENCE by same by a curve to the left, having
a radius of 175.00 feet, an arc length of 40.37 feet, to a point, the place of BEGINNING,
BEING Lot No. 70 of the Final Subdivision Plan for Hillside Farms - Phase V,
dated July 10, 2006, last revised December 29, 2006, prepared by H. Edward Black &
Associates, P.C., and recorded in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania to Instrument No.: 200820865.
UNDER AND SUBJECT to a Declaration of Covenants and Restrictions dated
April 30, 1996 and recorded in the Office of the Recorder of Deeds of Cumberland County in
Miscellaneous Book 529, Page 333, as amended by an Amendment to Declaration of Covenants
and Restrictions dated September 30, 1997, recorded in the Office of the Recorder of Deeds of
Cumberland County in Miscellaneous Book 562, Page 52 and as further amended by a Second
Amendment dated June 29, 2000, recorded in the Office of the Recorder of Deeds of Cumberland
County in Miscellaneous Book 648, Page 702, and as amended by a Third Amendment dated
July 16, 2003 and recorded in Cumberland County Miscellaneous Book 700, Page 1105, an as
amended by a Fourth Amendment dated April 20, 2010 and recorded in the Office of the
Recorder of Deeds of Cumberland County, Pennsylvania to Instrument No. 201011267.
BEING THE SAME premises which James W. Mumper, Jr. by his deed dated
September 24, 2013 and recorded September 27, 2013 in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania in Instrument No.: 201331974, granted and conveyed
unto Vijay N. Cheleenahalli and Naga Kalpana Pilli, husband and wife.
NOW, the
13 day of November, 2013, at the time of and immediately
before the execution of the principal contract, and before any authority has been given by the said
Vijay N. Cheleenahalli and Naga Kalpana Pilli, husband and wife to the said J. W. Mumper
Construction, Inc., a Pennsylvania Corporation to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with J. W.
Mumper Construction, Inc., a Pennsylvania Corporation and the further consideration of One
Dollar, to J. W. Mumper Construction, Inc., a Pennsylvania Corporation paid by Vijay N.
Cheleenahalli and Naga Kalpana Pilli, husband and wife it is agreed that no lien shall be filed
against the building by the contractor, or any sub - contractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
